Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 6: - PLATTING PROCEDURES <br />DIVISION 4: - PRELIMINARY DEVELOPMENT PLATS <br />(1) The Preliminary Development Plat is consistent with all zoning requirements for the property, and any approved <br />development agreement; <br />(2) The Preliminary Development Plat conforms to the approved Watershed Protection Plan (Phase 1); <br />(3) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities to serve the <br />development site conform to the master facilities plans for such facilities, including without limitation the water <br />facilities, wastewater facilities, transportation, drainage and other master facilities plans; <br />(4) The proposed provision and configuration of roads, water, wastewater, drainage and park facilities are adequate <br />to serve the development and meet the standards of Chapters 6 and 7 of this Land Development Code; <br />(5) Easements or rights -of -way for all public water, sanitary sewer, roadway and drainage facilities have been <br />designated; <br />(6) Fire lanes access easements or street rights -of -way have been provided for access to all fire hydrants and fire <br />department connections; <br />(7) Easements have been designated for all landscaped buffers and open space; and <br />(8) The plat meets any county standards to be applied under an interlocal agreement between the City and a <br />county under Tex. Loc. Gov't Code ch. 242, where the proposed development is located in whole or in part in <br />the extraterritorial jurisdiction of the City and in the county. <br />Section 1...6„ ...6 ,,. IIf;;° Ipiiiir tiiioin and IIf;;° f iira iii0in <br />The approval of a Preliminary Development Plat application shall remain in effect for a period of two years from the <br />date the application was approved or conditionally approved by the Planning and Zoning Commission, during which <br />period the applicant shall make progress towards completion of a Final Development Plat for the land subject to the <br />Preliminary Development Plat (as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as amended). <br />If no progress has been made towards completion of a Final Development Plat of the property covered by the Preliminary <br />Development Plat (as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as amended) within the <br />two -year period, the Preliminary Development Plat approval shall expire and the plat shall be null and void, unless <br />extended in accordance with Article 3, Division 5 of this Chapter 1. If progress is made towards completion of a Final <br />Development Plat for the land subject to the Preliminary Development Plat (as defined in V.T.C.A., Texas Local <br />Government Code, Section 245.005(c) as amended) during the two -year period, but after the progress is made, no further <br />progress is made towards completion of a Final Development Plat for the land subject to the Preliminary Development <br />Plat (as defined in V.T.C.A., Texas Local Government Code, Section 245.005(c) as amended) for a period of two years, <br />the Preliminary Development Plat approval shall expire and the plat shall be null and void, unless extended in accordance <br />with Article 3, Division 5 of this Chapter 1. <br />In accordance with Article 3, Division 5, the Commission may extend the expiration date of the Preliminary <br />Development Plat for a period not to exceed one year. <br />Section 1...6„ 47 ,,. Minor changes in the design of the development subject to a Preliminary Development Plat may be <br />incorporated in an application for approval of a Final Development Plat without the necessity of filing a new <br />application for approval of a Preliminary Development Plat. Minor changes shall include adjustment in street or alley <br />alignments, lengths, and paving details, provided that such changes are consistent with any approved priority <br />applications. <br />San Marcos, Texas, Code of Ordinances Page 86 <br />
