Subpart B - LAND DEVELOPMENT CODE <br />Chapter 1 - DEVELOPMENT PROCEDURES <br />ARTICLE 6: - PLATTING PROCEDURES <br />DIVISION 5: - FINAL SUBDIVISION PLATS AND FINAL DEVELOPMENT PLATS <br />b. Watershed Protection Plan (Phase 2), unless the applicant has elected to satisfy Watershed Protection <br />Plan (Phase 2) requirements through approval of a development plat; <br />c. Preliminary Development Plat, unless the applicant has elected to eliminate this stage of the platting <br />process; <br />d. Construction plans; and <br />A Traffic Impact Analysis. <br />(b) Accompanying Applications. <br />(1) An application for approval of a Final Subdivision Plat may be accompanied by an application for approval of a <br />Site Preparation Permit for one or more proposed lots, provided that the Final Subdivision Plat shall be decided <br />prior to decision on any Site Preparation Permit. <br />(2) An application for approval of a Final Development Plat may be accompanied by an application for approval of a <br />Site Preparation Permit for the land subject to the plat, provided that the Final Development Plat shall be <br />decided prior to decision on any Site Preparation Permit. <br />Section 1...6„ 6„ 3 ,,. AppIllicatiloin Requirements <br />O p q II NDirector shall be the responsible official for a Final Subdivision Plat or a Final <br />a Responsible Official. The II - I:dr7�r7or7�d, <br />Development Plat. <br />(b) Contents. An application for approval of a Final Development Plat shall be prepared in accordance with Chapter 1 of <br />the Technical Manual. <br />(c) Consent of Lienholders. The applicant shall furnish with the application to the City a current title commitment issued <br />by a title insurance company authorized to do business in Texas policy, or a title opinion letter from an attorney <br />licensed to practice in Texas, identifying all persons having an interest in the property subject to the plat, including <br />lienholders. The applicant shall submit a written agreement executed by each lienholder consenting to the platting of <br />the property and to the dedications and covenants that may be contained in the plat. The title commitment or title <br />opinion letter and consent agreement shall be subject to review and approval by the City Attorney. <br />Section 1...6 „6„ 4 ,,. IlD iii iiion <br />(a) Decision. The Planning and Zoning Commission shall decide whether to approve, approve with conditions, or deny <br />the Final Subdivision Plat or Final Development Plat application. The Commission also shall decide any appeal of the <br />Engineering Director's decision on construction plans. <br />(b) Certification. A notation of the action taken on each Final Subdivision Plat or Final Development Plat application and <br />the reasons therefore shall be entered in the minutes of the Planning and Zoning Commission. The Director's <br />notification to the applicant under Article 3, Division 2 of this Chapter 1 following approval of a Final Subdivision Plat <br />or Final Development Plat shall constitute certification that the plat has been approved by the Commission. <br />Section 1...6 „6 „6 ,,.
