The property owner shall maintain all required public improvements during <br />construction of the development. <br />(b) Bond. The owner shall covenant to warranty the required public improvements for a period of one year following <br />acceptance by the City of all required public improvements and shall provide a maintenance bond in the amount of <br />20 percent of the costs of the improvements for such period. Illirmmlpa f III :: ee Offsets <br />Whenever a property owner seeks to offset the costs of dedicating rights -of -way or constructing one or more public <br />improvements required by this Land Development Code against impact fees due from a development, the owner may <br />request inclusion of such provisions in the subdivision improvement agreement required by Section 1.6.6.3, or if the <br />dedication or construction has occurred prior to Final Subdivision Plat or Final Development Plat approval, the owner may <br />propose a subdivision improvement agreement that incorporates the offsets against impact fees. The Director shall <br />determine the amount of the offsets due, if any, in accordance with the standards contained in Chapter 7, Division 1 of this <br />Land Development Code. The agreement shall be subject to approval by the Planning and Zoning Commission with the <br />Final Subdivision Plat or the Final Development Plat application, and the Commission's decision may be appealed to the <br />City Council in accordance with Article 10, Division 6 of this Chapter 1. <br />San Marcos, Texas, Code of Ordinances Page 96 <br />
