BOX 12276 AUSTIN, TEXAS 78711 ( 512 )463-61 00 <br /> CERTIFIED LOCAL GOVERNMENT GRANT <br /> This agreement is entered into by the Texas Historical <br /> Commission, a state Agency, hereinafter referred to as the <br /> Commission, and the City of San Marcos, hereinafter referred to <br /> as the Contractor, pursuant to a grant made to the Commission for <br /> Fiscal Year 1990, by the u.S. Department of the Interior, <br /> National Park Service, under the provisions of the National <br /> Historic Preservation Act of 1966, P.L. 89-665 (16 U.S.C. Sec. <br /> 470 f). This grant is made for the purpose of funding a project <br /> or projects to be undertaken by the Contractor as a participant <br /> in the Certified Local Government program. <br /> The Contractor in consideration of the hereinafter monetary <br /> sum to be paid by the Commission agrees as follows: <br /> SEC. 1. The Contractor shall undertake and complete the <br /> project and/or projects detailed in the Project Proposal <br /> (Attachment I), to De executed within the jurisdiction of the <br /> City of San Marcos, Texas, in the County of Hays, Texas. <br /> SEC. 2. It is agreed that the Contractor shall be an <br /> independent Contractor for the purposes of this Agreement. The <br /> Contractor shall not be considered the agent, the servant, or the <br /> employee of the Commission for any purpose whatsoever. The <br /> liabilities of any kind arising from the performance of the <br /> contracted work covered by this Agreement and all Appendices <br /> thereto are the responsibility of the Contractor. <br /> SEC. 3. In the event that the Contractor proposes to <br /> undertake an inventory of cultural resources in the City of San <br /> Marcos, then the Contractor shall be required to enter into an <br /> Architectural Survey Agreement with the Commission, and to <br /> fulfill all of the requirements stated in that contract document <br /> and in IIGuidelines for Survey and Planning Grantsll (Attachment <br /> II). <br /> SEC. 4.
