<br /> 95 <br /> FACILITIES MAINTENANCE AGREEMENT <br /> STATE OF TEXAS <br /> KNOW ALL PERSONS BY THESE PRESENTS <br /> COUNTY OF HAYS <br /> 1. Parties: The City of San Marcos, Texas, a Texas municipal <br /> corporation (the "City") and Southwest Texas State University (the <br /> "University"), each acting through its duly authorized representative. <br /> 2. Recitals: <br /> a. The University contracts with the Houston Oilers, I nc ., a <br /> Texas corporation (the "Oilers") for the operation of <br /> the Oi lers' training camp at various facilities of <br /> the University, including training fields, the <br /> University Stadium, dormitories, dining facilities, <br /> gymnasiums and auditoriums; and, <br /> b. The training camp operated by the Oilers is attended by <br /> a large press contingent, and directly and indirectly <br /> stimulates tourism and tourist activities in the City; <br /> and, <br /> c. The recent announcement of the Dallas Cowboys that they <br /> will move their summer training camp to the City <br /> of Austin will increase the interest of tourists in both <br /> the San Marcos and Austin areas during the time the <br /> two training camps are in operation; and, <br /> d. The City wishes to assist the University in the <br /> maintenance of the various facilities of the University <br /> used by the Oilers and by the public in connection <br /> with the operation of the Oilers' training camp; and, <br />
