<br /> -2- <br /> e. The City, in providing funding for this agreement, directs <br /> an expenditure of Hotel-Motel Tax Revenue in accordance <br /> with its duly adopted budget for the 1989-1990 fiscal <br /> year, and in accordance with the general purposes of <br /> facilities maintenance described in 3 S1. 101 (a) (1) of the <br /> Texas Tax Code, as amended. <br /> 3. City's Aqreement: The City agrees to contribute to the <br /> University the sum of Twelve Thousand and no/IOO Dollars ($12,000.00) <br /> towards the maintenance of the various facilities of the University <br /> used by the Oilers and by the public in connection with the operation <br /> of the Oilers' training camp to be conducted during July and August, <br /> 1990. The City agrees to make this contribution not later than July <br /> 31, 1990. <br /> 4. University's Agreement: The University agrees to use the <br /> contribution made by the City only for the purpose of defraying its <br /> maintenance expenses in connection with the operation of the Oilers' <br /> training camp as described above. The University expressly <br /> acknowledges that the use of these funds is limited by reason of their <br /> nature as Hotel-Motel tax revenues under Chapter 351 of the Texas Tax <br /> Code, as amended. The University agrees to maintain complete and <br /> accurate financial records regarding expenditures from this <br /> contribution, and shall make these records available for inspection and <br /> review upon written request by the City Manager of the City. The <br /> University agrees that if it cannot for any reason use all or any part <br /> of the contribution for the purposes specified, it shall immediately <br /> refund the entire unused amount to the City. <br />
