The Council asked Mr. Head several <br /> questions about the existing wall at the plant that is beginning to <br /> weaken. Mr. Head has looked at the wall and has made some recommenda- <br /> tions to the City for temporary support of the wall. Freese and <br /> Nichols has recommended a monitoring system to monitor the wall's <br /> weakness. In the plans for improvemenffiFreese and Nichols has re- <br /> commended replacement of the aerator basin rather than repair, as it <br /> would be more costly to repair it. Jim Byrn asked City Manager Gon- <br /> zalez what portion of the $919,000 improvements would go for the <br /> 500,000 gallon expansion and what for new improvements. He stated <br /> he wanted there to be a fair allocation of funds, even if that <br /> meant a $900 fee rather than $750. He stated new growth should pay <br /> for new growth. Regarding the $900 fee for reservation, City Manager <br /> Gonzalez stated the person benefiting from the reservation should pay <br /> for that privilege, and that the fee was reasonable. Patrick Miller <br /> stated he felt the $900 reservation fee was penalizing developers, <br /> and that the 3-year reservation time should be reviewed to possibly <br /> increase the time to 5 years. Jim Byrn had expressed this concern <br /> also at the first reading of the Ordinance. <br /> Mr. Farr moved to amend the Ordinance in Sections 30-40 and 30-50 as <br /> Mr. Fisher had recommended, and Mr. Brown seconded the motion. The <br /> amendnlents to Sections 30-40 and 30-50 -were thén read into the re- <br /> cord as follows: <br /> "Section 30-40. Purpose of Charge. The intent of the sewage system <br /> capital recovery fee shall be to recover and pay the costs of con- <br /> struction of sewage treatment and major sewage collection works as <br /> described in the City of San Marcos Facility plan for sanitary sewage <br /> system, to the extent permitted by and in compliance with the ordinances <br /> authorizing the City's outstanding waterworks and sewer system revenue <br /> bonds and obligations issued to be payable in whole or in part from <br /> the revenue bonds and obligations issued to be payable in whole or in <br /> part from the revenues of the City's waterworks and sewer system. Said <br /> fees shall be applied as provided in Section 30-50 of this Ordinance; <br /> and the City of San Marcos Sewer System Capital Improvement Fund pro- <br /> vided in Section 30-50 shall be applied by the City to the payment of <br /> such construction costs as and in the manner the City from time to <br /> time deems necessary and appropriate." <br /> "Section 30-50. Capital Recovery Fee Fund. All amounts collected under <br /> this Division shall be deposited to the Water and Sewer System Revenue <br /> Fund established and maintained in accordance with the Ordinance author- <br /> izing the City's Junior Lien Waterworks and Sewer System Revenue Bonds, <br /> Series 1968, to be applied pursuant to the provisions of said Ordinance <br /> as revenue arising from the operat~on or ownership of the City's com- <br /> bined waterworks and sewer system. Surplus funds remaining in said <br /> Revenue Fund at the end of each month, after all expenditures, deposits, <br /> and transfers required by said Ordinance and the ordinances authorizi~ <br /> any bonds or other obligations issued to be payable in whole or in part: <br /> from revenues of the City's waterworks and sewer system have been made <br /> therefrom, not exceeding the total amount of CRF's deposited to said <br /> Revenue Fund during such month, shall be deposited to a fund, separate <br /> and apart from said Revenue Fund and all other funds of the City, to <br /> be designated as 'City of San Marcos Sewer System Capital Improvement <br /> Fund'. Said Fund shall be established and maintained at an official <br /> depository bank of the City and shall be used for the purposes stated <br /> in Section 30-40 of this Ordinance." <br /> The Council then voted unanimous approval of the amendments. <br />
