<br /> 6 <br /> ORTHtJANC¡:'; 19Q()- 47 <br /> <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> ~.1ARCOS, TEXAS, ADOPTING A FOUR-STAGE INTERIM WATER <br /> CONSERVATION PLAN; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR <br /> PENALTIES; PROVIDING FOR PUBLICATION; DECLARING AN <br /> EMERGENCY AND PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, the Texas Water Commission has proposed that a <br /> comprehensive uniform plan of water conservation measures be undertaken <br /> across Hays, Comal, Bexar, Medina and Uvalde Counties in response to <br /> the declining level of the Edwards Aquifer, and the potential threat to <br /> continued flows at Comal and San Marcos Springs; and, <br /> WHEREAS, this plan is to be operative during an interim period in <br /> which a regional plan for the management of the water resources of the <br /> Edwards Aquifer is to be finalized and adopted; and, <br /> WHEREAS, this water conservation plan differs from, and is <br /> intended to supersede the City's existing ordinances regulating the use <br /> of water during the interim period in which the regional management <br /> plan is finalized; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. SUPERSESSION OF EXISTING ORDINANCES. That the <br /> regulations contained in this ordinance shall supersede the provisions <br /> of Sections 30-10 through 30-12, inclusive, of the San Marcos Code of <br /> Ordinances, during the period beginning on the effective date of this <br /> ordinance and ending on December 31, 1990. At that time, Sections <br /> 30-10 through 30-12, inclusive, of the San Marcos Code of Ordinances <br /> shall again take effect unless the regulations contained in this <br /> ordinance are continued in effect by action of the City Council. <br /> SECTION 2. STAGES OF WATER CONSERVATION MEASURES. The City <br /> Manager is authorized to issue orders implementing the following stages <br /> of water conservation measures at the respective levels (mean sea <br /> level) indicated for the Bexar County Edwards Aquifer monitor well <br /> (J-17): <br /> STAGE I AQUIFER AWARENESS 644 feet <br /> STAGE 2 AQUIFER WATCH 628 feet <br /> STAGE 3 AQUIFER ALERT 612 feet <br /> In addition, the City Manager is authorized to issue orders <br /> implementing STAGE 4, AQUIFER RISK, of water conservation measures <br /> whenever water quality monitoring by the Edwards Underground Water <br /> District shows an increase in TDS (Total Dissolved Solids) of 30% or <br /> more above the historical average, or when the TDS value for any public <br /> supply well from the Edwards Aquifer exceeds allowable maximums. STAGE <br /> 4 may be implemented at any time a STAGE 2 or STAGE 3 order is in <br /> effect. <br /> SECTION 3. WATER CONSERVATION ORDERS. Orders implementing the <br /> various stages of water conservation measures shall be in writing, <br /> shall state the required water conservation measures, shall be <br /> publicly announced, and shall take effect upon publication one time <br /> in a daily newspaper of general circulation within the city. An <br /> order, once implemented, shall continue in effect until it is <br /> either rescinded by written order of the City Manager, or <br /> superseded by an order implementing a h ighe r stage of <br /> water conservation measures. <br />
