<br /> -2- <br /> SECTION 4. PROHIBITED VIOLATION OF WATER CONSERVATION ORDERS. <br /> During each of the respective stages of water conservation measures, <br /> it shall be unlawful for any person to knowingly or intentionally <br /> violate or cause the violation of any restriction or prohibition <br /> on the use of water or related activities made applicable to the <br /> respect i ve stage of water conservation measures described in the <br /> attached table of "REDUCTION MEASURES. " Where a water use restriction <br /> calls for use only once every seven ( 7) days, or only on designated <br /> days, the following system shall apply to determine the day within each <br /> calendar week that the use is permitted: <br /> Buildings and premises with even-numbered addresses- Tuesdays only <br /> beginning at 8:00 p.m. and ending Wednesdays at 8:00 a.m. <br /> Buildings and premises with odd-numbered addresses- Thursdays only <br /> begining at 8:00 p.m. and ending Fridays at 8:00 a.m. <br /> SECTION 5. PENALTIES. A person who knowingly or intentionally <br /> violates or causes the violation of any restriction or prohibition on <br /> the use of water or related activities contained in the following <br /> stages of Water Conservation Orders shall be deemed guilty of a <br /> misdemeanor and upon conviction shall be punished by a fine in <br /> the respective amounts shown for each stage: <br /> STAGE I Not less than $25 nor more than $100. <br /> STAGE II Not less than $50 nor more than $200. <br /> STAGE III Not less than $50 nor more than $500. <br /> STAGE IV Not less than $100 nor more than $1,000. <br /> SECTION 6. That if any word, phrase, clause, sentence, or <br /> paragraph of this ordinance is held to be unconstitutional or <br /> invalid by a court of competent jurisdiction, the remaini ng <br /> provisions of this ordinance shall remain in effect as if the <br /> unconstitutional or invalid portion had not been adopted. <br /> SECTION 7. That the importance of this Ordinance creates an <br /> emergency and an imperative public necessity so that the provisions of <br /> the Charter requiring that ordinances shall be presented at three <br /> separate meetings and that no ordinance shall become effective until <br /> the expiration of ten (10) days following the date of its final <br /> passage be suspended, and these provIsIons are hereby suspended, <br /> and this Ordinance shall take effect and be in full force and effect <br /> from and after its adoption and after its publication in a ne\'I1spaper <br /> of general circulation within the City as provided by the City Charter <br /> of the City of San Marcos. <br /> PASSED, APPROVED AND ADOPTED this of J¡t'~ <br /> ;¿est:. it u <br /> ~n~om ~~ <br /> City Secretary <br /> Approved: <br /> ~ <br /> City Attorney <br /> PUBLISHED IN THE SAN MARCOS DAILY RECORD, JULY 8, 1990. <br />
