7l Regular Meeting November 28, 1983 Page 2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE II. SERVICE CHARGES, OF CHAPTER 30, WATER AND SEWERS AND SEWAGE DISPOSAL, DIVISION 4, SEWERAGE SYSTEM CAPITAL RECOVERY FEE OF THE CODE OF ORDINANCES OF SAN MARCOS, TEXAS AND DE- CLARING AN EFFECTIVE DATE. Mayor Craddock asked if anyone wished to speak in favor of the Ordin- ance, and no one did. Mayor Craddock asked if anyone had questions or wished to oppose the Ordinance. Gayle Ross addressed the City Manager regarding his concerns. No one else wished to speak, so Mayor Craddock closed the public hearing. Mr. Guerra moved to approve the Ordinance on first reading and Mayor Craddock seconded the motion. The City Manager requested the Council consider amendments to the Ordinance. After discussion Mr. Guerra moved to amend the Ordinance in Section 30-45 (g) and Mayor Craddock seconded the motion. The amendment was read into the record as follows: " (g) 1. Office .0002 LUE/square footage of building 2. Office w/showers .0004 LUE/square footage of building 3. Industrial .0002 LUE/square footage of building with adjustments for increases in CRFN fee due on an annual basis for the following three years. Adjust- ment procedures used will follow process outlined in Section 30-48." Mr. Farr then moved to amend the Ordinance in Section 30-45.1(c) to change (c) to read as follows: " (c) Hotel/Motels with .79 LUE/Room Restaurant and/or Bar". Mr. Kissler seconded the motion, which passed unanimously. The Council then voted unanimous approval of Mr. Guerra's amendment above. The Council then voted unanimous approval of the Ordinance on first reading, as amended. (Due to a technical error on first reading November 14, 1983, the Council voted this Ordinance on first reading at this meeting). Mayor Craddock opened a public hearing to consider approval of a Zoning Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 3.8 ACRES OF LAND AREA IN THE J. M. VERAMENDI LEAGUE NO. 2 IN SAN MARCOS, HAYS COUNTY, TEXAS, LOCATED IN THE 1100 BLOCK OF UH- LAND ROAD EAST, FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) TO "MH" (MOBILE HOME DISTRICT).
