72 Regular Meeting November 28, 1983 Page 3 Mayor Craddock asked if anyone wished to speak in favor of the zon- ing request. Jim Byrn stated he was present representing the owner of the property, Joe Dobie, and that he would answer any questions the Council had. In response to Ms. Kissler's question, Mr. Byrn stated the property would be used for recreational vehicles and not for tied-down mobile homes. No one else wished to speak in favor or in opposition to the zoning change, so Mayor Craddock closed the public hearing. Mr. Farr moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion, which passed unanimously. Mayor Craddock introduced for consideration adoption of an Ordinance on emergency, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 2-43 OF DIVISION 2, ENTITLED "TEXAS MUNICIPAL RETIREMENT SYSTEM" OF ARTICLE III, ENTITLED "CIVIL SERVICE AND EMPLOYEE BENEFITS" OF CHAPTER 2 OF THE CODE OF ORDINANCES OF SAID CITY BY AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, 'UPDATED SERVICE CREDIT' IN SAID SYSTEM FOR SERVICE PERFORMED BY QUALI- FYING MEMBERS OF SUCH SYSTEM IN THE EMPLOYMENT OF SAID CITY; AND ADDING A PARAGRAPH (b) TO SAID SECTION AUTHOR- IZING AND ALLOWING UNDER SAID ACT 'UPDATED SERVICE CREDIT' FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF SUCH SYSTEM WHO HAVE UNFORFEITED CREDIT FOR PRIOR SERVICE AND/OR CURRENT SERVICE WITH OTHER PARTICIPAT- ING MUNICIPALITIES BY REASON OF PREVIOUS SERVICE AND WHO WERE CONTRIBUTING MEMBERS ON JANUARY 1, 1983; AMENDING SECTION 2-44 OF SAID DIVISION AND SAID ARTI- CLE OF CHAPTER 2 OF SAID CODE; AND DECLARING AN EMER- GENCY. Mr. Brown moved for adoption of the Ordinance on emergency and Mr. Guerra seconded the motion. Gary Anderson of the Texas Municipal Retirement System was present and reviewed provisions of the Ordin- ance with the Council regarding the updated service credit and increase to annuitants and stated these were provisions that could be adopted annually by the Council. The Council voted unanimous approval of the Ordinance on emergency. Mayor Craddock introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 13 1/2-2 AND 13 1/2-3 OF CHAPTER 13 1/2 ENTITLED "HEATING AND AIR CONDITION- ING" OF THE CODE OF ORDINANCES OF SAID CITY AND ADDING A PARAGRAPH (b) TO SAID SECTION 13 1/2-3 OF SAID CHAPTER l3 1/2 OF SAID CODE AND DECLARING AN EFFECT- IVE DATE. Mr. Brown moved for approval of the Ordinance on first reading and Ms. Kissler seconded the motion. C. E. O'Bryant of the Heating and Air Conditioning Board was present and reviewed the suggested changes with the Council. After much discussion Mr. Brown requested more in- formation be presented to the Council regarding health hazards of use of fiberglass and the pros and cons of using various materials and the economics of the various materials prior to third reading of the Ordinance. On roll call the following vote was recorded:
