AMENDMENT NO.1 TO TEXAS COMMUNITY DEVELOPMENT PROGRAM CONTRACT NO. 708402 TEXAS DEPARTMENT OF COMMERCE AND THE CITY OF SAN MARCOS STATE OF TEXAS COUNTY OF TRAVIS Section 1. The Texas Department of Commerce, an agency of the State of Texas, hereinafter referred to as "Department", and the City of San Marcos, hereinafter referred to as "Contractor", do hereby contract and agree to amend their original contract, as initially executed by the Executive Director of Department effective June 30, 1989, through June 29, 1991, for the performance of economic development activities. Section 2. The parties hereto agree to amend the coNtract identified in Section 1 above so that SECTION 22. SPECIAL CONDITIONS H. is revised to read hereafter as given below: H. Contractor shall submit to Department documentation (Le. a resolution) of its local funding commitment of Three Hundred Sixty-eight Thousand Two Hundred Seventy- seven and No/100 Dollars ($368,277) for completion of the project funded under this contract prior to Department's release of project funds for such project. Section 3. The parties hereto agree to amend the contract identified in Section 1 above so that Exhibit A, Performance ~tatement, is revised to read hereafter as given in the Performance Statement attached to this amendment, hereinafter referred to as Exhibit A, and hereby made a part of this amendment. Exhibit A consists of two (2) pages. Section 4. The parties hereto agree to amend the contract identified in Section 1 above so that the Budget, Exhibit Bt is revised to read hereafter as given in the Budget attached to this amendment, hereinafter referred to as Exhibit B, and hereby made a part of this amendment. Exhibit B consists of one (1) page. Section 5. The parties hereto agree that this amendment shall become effective on November 1, 1990. Page 1 of 2
