-4- ( d) An officer or employee who is a member of a body before which a decision is pending, and who complies with the disclosure requirements of this section, is not required to abstain from participation and voting in a matter if a majority of the members of the body is composed of persons who are likewise required to make a disclosure and who make a disclosure in accordance with this section. Sec. 2-75. Contracts with city; eligibility for appointment or election to office. (a) A person is ineligible for election or appointment to a position as an officer of the city if the person has an ownership interest in a business entity that has a contract or contracts for the sale to the city of any land, materials, supplies or service in an amount of $7,500 or more annually; provided that city council members shall be subject to subsection (b) below. Any city officer, other than a city council member, who becomes ineligible under this provision while in office shall forfeit the office held. Any violation of these provisions shall render any contract entered into between the city and the business entity during the period of the violation voidable by the city manager or the city council. (b) No member of the city council, and no employee of the city shall have a financial interest in the sale to the city of any land, materials, supplies or service, outside of the person's position with the city. Any person having such an interest shall be ineligible for election as a city council member or appointment as an employee of the city, and any city council member or employee who acquires such an interest shall forfeit the office or employment. Any violation of this provision with the actual or constructive knowledge of the city council member or employee shall render the contract voidable by the city manager or the city council. ( c) These provisions shall not apply to acquisition of property by the city as a result of eminent domain proceedings or the threat of eminent domain proceedings. DIVISION 2. FINANCIAL DISCLOSURE Sec. 2-81. Definitions. For the purposes of this division, the following words shall have these meanings: Business entity: A corporation, partnership, sole proprietorship, firm, holding company, joint stock company, receivership, trust, or any other entity organized for profit. Candidate: Every person who declares for or files for any office of the City of San Harcos to be filled by election. City official: The mayor, every member of the city council, the city manager, the city attorney, the city secretary, judges of the municipal court, and persons acting in the capacity of these officers or employees. Compensation: Any economic benefit received in return for labor, services, property or investment. Economic benefit: Any money, real or personal property, purchase, sale, lease, contract, option, credit, loan, discount, service, or other tangible or intangible thing of value, whether similar or dissimilar to those enumerated.
