<br /> -4- <br /> ( d) An officer or employee who is a member of a body <br /> before which a decision is pending, and who complies with the <br /> disclosure requirements of this section, is not required to <br /> abstain from participation and voting in a matter if a majority <br /> of the members of the body is composed of persons who are <br /> likewise required to make a disclosure and who make a <br /> disclosure in accordance with this section. <br /> Sec. 2-75. Contracts with city; eligibility for appointment <br /> or election to office. <br /> (a) A person is ineligible for election or appointment <br /> to a position as an officer of the city if the person <br /> has an ownership interest in a business entity that has a <br /> contract or contracts for the sale to the city of any land, <br /> materials, supplies or service in an amount of $7,500 or more <br /> annually; provided that city council members shall be <br /> subject to subsection (b) below. Any city officer, other <br /> than a city council member, who becomes ineligible under <br /> this provision while in office shall forfeit the office held. <br /> Any violation of these provisions shall render any contract <br /> entered into between the city and the business entity during <br /> the period of the violation voidable by the city manager or <br /> the city council. <br /> (b) No member of the city council, and no employee of the <br /> city shall have a financial interest in the sale to the city <br /> of any land, materials, supplies or service, outside of <br /> the person's position with the city. Any person having such <br /> an interest shall be ineligible for election as a city <br /> council member or appointment as an employee of the city, <br /> and any city council member or employee who acquires such an <br /> interest shall forfeit the office or employment. Any <br /> violation of this provision with the actual or constructive <br /> knowledge of the city council member or employee shall render <br /> the contract voidable by the city manager or the city <br /> council. <br /> ( c) These provisions shall not apply to acquisition of <br /> property by the city as a result of eminent domain <br /> proceedings or the threat of eminent domain proceedings. <br /> DIVISION 2. FINANCIAL DISCLOSURE <br /> Sec. 2-81. Definitions. <br /> For the purposes of this division, the following words shall <br /> have these meanings: <br /> Business entity: A corporation, partnership, sole <br /> proprietorship, firm, holding company, joint stock company, <br /> receivership, trust, or any other entity organized for profit. <br /> Candidate: Every person who declares for or files for any <br /> office of the City of San Harcos to be filled by election. <br /> City official: The mayor, every member of the city council, <br /> the city manager, the city attorney, the city secretary, <br /> judges of the municipal court, and persons acting in the <br /> capacity of these officers or employees. <br /> Compensation: Any economic benefit received in return for <br /> labor, services, property or investment. <br /> Economic benefit: Any money, real or personal property, <br /> purchase, sale, lease, contract, option, credit, loan, <br /> discount, service, or other tangible or intangible thing of <br /> value, whether similar or dissimilar to those enumerated. <br />
