<br /> 93 <br /> RESOLUTION 1990- 101 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> HARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN <br /> AGREEHENT BETWEEN THE CITY AND SAN MARCOS TELEPHONE <br /> COHPANY PERTAINING TO UTILITY RELOCATION FOR THE LOOP <br /> 82 RECONSTRUCTION PROJECT AND EASEMENTS FOR TELEPHONE <br /> FACILITIES AT THE SAN MARCOS HUNICIPAL AIRPORT; <br /> AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT <br /> AND RELATED DOCUHENTS; AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City owns certain property situated in the William <br /> Pettus Two League Grant, in Caldwell County, Texas, adjacent to State <br /> Highway No. 21 and Airport Entrance Drive (the "City Property"); and, <br /> "mE REAS, the San Harcos Telephone Company (SHTC) has utility <br /> easements and utilities in place within right-of-way owned by the <br /> r1issouri Pacific Railroad Company at the intersection of the railroad <br /> right-of-way and the Loop 82- Post Road intersection in the City of San <br /> Marcos, Texas; and, <br /> ~.qHEREAS, the Texas Department of Highways and Public Transporation <br /> and the City plan to realign the Loop 82- Post Road intersection, <br /> requiring the relocation of the SMTC utilities within the private <br /> railroad right-of-way and the private easements of others; and, <br /> "\lHE REAS, SMTC needs easements from the City to place its <br /> facilities within those portions of the City Property as set out in the <br /> metes and bounds descriptions attached as Exhibits A, B, C and D; and, <br /> WHEREAS, SMTC is willing to relocate its utilities at the Loop 82- <br /> Post Road intersection in exchange for the City granting easements to <br /> SMTC on the City property; now, there fore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the agreement attached <br /> to this Resolution between the City and the San Marcos Telephone <br /> Company pertaining to utility relocation for the Loop 82 reconstruction <br /> project and easements for telephone facilities at the San Marcos <br /> Municipal Airport are hereby approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is hereby <br /> authorized to execute the agreement, together with the related <br /> easements and other documents, on behalf of the City. <br /> PART 3.
