<br /> 94 <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> This Agreement is made by and between the CITY OF SAN MARCOS (the <br /> "City") and SAN MARCOS TELEPHONE COMPANY, INCORPORATED ("SMTC") as <br /> follows: <br /> HHEREAS, the City owns certain property situated in the William <br /> Pettus Two League Grant, in Caldwell County, Texas, adjacent to State <br /> Highway No. 21 and Airport Entrance Drive (the "City Property")¡ and <br /> WHEREAS, SMTC has utility easements and utilities in place within <br /> right-of-way owned by the Missouri Pacific Railroad Company at the <br /> intersection of the railroad right-of-way and the Loop 82- Post Road <br /> intersection in the City of San Marcos, Texas¡ and, <br /> WHEREAS, the Texas Department of Highways and Public <br /> Transportation and the City plan to realign the Loop 82- Post Road <br /> intersection, requiring the relocation of the SMTC utilities within <br /> the private railroad right-of-way and the private easements of <br /> others¡ and, <br /> 'VmEREAS, SMTC needs easements from the City to place its <br /> facilities within portions of the City Property as set out in the metes <br /> and bounds descriptions contained within the easement attached hereto <br /> as Attachment 1; and, <br /> WHEREAS, SMTC is willing to relocate its utilities at the Loop 82- <br /> Post Road intersection in exchange for the City granting easements <br /> to SMTC on the City property; it is, therefore, AGREED as follows: <br /> 1. SMTC will remove and relocate equipment and facilities owned <br /> by SMTC from their present location near the Loop 82-Post Road <br />
