27.Consider approval of Resolution 2013 -116R, approving an agreement with Union Pacific <br />Railroad Company for the City to purchase 1.851 acres of land adiacent to the railroad <br />crossing at South LBJ Drive and Edward Gary Street for the price of $423,305.00; <br />authorizing the City Manager to execute said agreement; authorizing the City Manager <br />to accept and execute all assignments of leases, licenses and other agreements for the use <br />of said property by third parties; authorizing the City Manager to execute all closing <br />documents related to such purchase; and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Becak, MOTION TO AMEND: Upon a motion made by Council Member Porterfield <br />and a second by Council Member Becak, the City Council voted seven (7) for and none (0) <br />opposed, to amend to state, "for a price not to exceed $423,305.00 based on a final survey at a <br />price of $5.25 per square foot." MAIN MOTION: the City Council voted seven (7) for and <br />none (0) opposed, to approve Resolution 2013 -116R. The motion carried unanimously. <br />28.Consider approval, by motion, of a proposal to set the 2013 tax rate at 53.02 cents per <br />$100 valuation which is higher than the effective tax rate. <br />MOTION: Upon a motion made by Council Member Guerrero and a second by Council <br />Member Thomason, the City Council voted six (6) for and one (1) opposed, Council Member <br />Scott, to approve a proposal to set the 2013 tax rate at 53.02 cents per $100 valuation which is <br />higher than the effective tax rate. The motion carried. <br />29.Hold discussion and finalize the proposed amendments to the San Marcos City Charter, <br />and provide direction to Staff. <br />Following Council discussion the Council reached consensus regarding the text amendment to <br />the City Charter Section 7.01. Planning and Zoning Commission by selecting Option 2: <br />"Allowing the appointment of one or two planning and zoning commissioners who do not own <br />real property in the city" to be included along with the other proposed propositions. <br />30.Receive a Staff presentation and hold discussion regarding the proposed Fiscal Year <br />2013 -2014 Budget, and provide direction to Staff. <br />Following discussion the Council directed Staff to bring back information regarding the cost of <br />litter clean ups along 35 at the next regular meeting. <br />31.Receive a presentation and hold discussion regarding the Lone Star Rail District, and <br />provide direction to Staff. <br />Joe Black and Joe Lassard with the Lone Star Rail District, provided a brief presentation. <br />Following discussion the Council directed Staff to bring back a resolution and calendar to the <br />next regular meeting on August 20, 2013. <br />32.Ouestion and Answer Session with Press and Public <br />None. <br />
