27.Consider approval of Resolution 2013 -116R, approving an agreement with Union Pacific Railroad Company for the City to purchase 1.851 acres of land adiacent to the railroad crossing at South LBJ Drive and Edward Gary Street for the price of $423,305.00; authorizing the City Manager to execute said agreement; authorizing the City Manager to accept and execute all assignments of leases, licenses and other agreements for the use of said property by third parties; authorizing the City Manager to execute all closing documents related to such purchase; and declaring an effective date. MOTION: Upon a motion made by Council Member Thomason and a second by Council Member Becak, MOTION TO AMEND: Upon a motion made by Council Member Porterfield and a second by Council Member Becak, the City Council voted seven (7) for and none (0) opposed, to amend to state, "for a price not to exceed $423,305.00 based on a final survey at a price of $5.25 per square foot." MAIN MOTION: the City Council voted seven (7) for and none (0) opposed, to approve Resolution 2013 -116R. The motion carried unanimously. 28.Consider approval, by motion, of a proposal to set the 2013 tax rate at 53.02 cents per $100 valuation which is higher than the effective tax rate. MOTION: Upon a motion made by Council Member Guerrero and a second by Council Member Thomason, the City Council voted six (6) for and one (1) opposed, Council Member Scott, to approve a proposal to set the 2013 tax rate at 53.02 cents per $100 valuation which is higher than the effective tax rate. The motion carried. 29.Hold discussion and finalize the proposed amendments to the San Marcos City Charter, and provide direction to Staff. Following Council discussion the Council reached consensus regarding the text amendment to the City Charter Section 7.01. Planning and Zoning Commission by selecting Option 2: "Allowing the appointment of one or two planning and zoning commissioners who do not own real property in the city" to be included along with the other proposed propositions. 30.Receive a Staff presentation and hold discussion regarding the proposed Fiscal Year 2013 -2014 Budget, and provide direction to Staff. Following discussion the Council directed Staff to bring back information regarding the cost of litter clean ups along 35 at the next regular meeting. 31.Receive a presentation and hold discussion regarding the Lone Star Rail District, and provide direction to Staff. Joe Black and Joe Lassard with the Lone Star Rail District, provided a brief presentation. Following discussion the Council directed Staff to bring back a resolution and calendar to the next regular meeting on August 20, 2013. 32.Ouestion and Answer Session with Press and Public None.
