Member Thomason and Council Member Scott to approve Ordinance 2013 -42, on the first of <br />two readings. The motion carried. <br />23.7:00 PM Receive a Staff Presentation and hold a Public Hearing to receive comments <br />for or against Resolution 2013 -115R, approving a Conditional Use Permit variance <br />under Section 4.3.4.2 of the Land Development Code to allow Tres Hermanas <br />Restaurant to serve alcohol for on -site consumption at 2550 Hunter Road which is <br />located less than 300 feet from Doris Miller Middle School; and declarin an effective <br />date; and consider approval of Resolution 2013 -115R. <br />Matthew Lewis, Director of Development Services, provided a brief presentation. <br />Mayor Daniel Guerrero opened the public hearing at 7:20 p.m. <br />There being no comments; the public hearing was closed at 7:20 p.m. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Porterfield, the City Council voted seven (7) for and none (0) opposed, to approve Resolution <br />2013 -115R. The motion carried unanimously. <br />Non Consent Agenda <br />24.Reconsider Ordinance 2013 -37, amending the Official Zoning Map of the City by <br />rezoning Lots 30 and 31, Block 2, Westover Addition Subdivision, located at 1402 and <br />1404 Clyde Street from SF -6 Single Family District to TH Townhouse Residential <br />District; and including procedural provisions. <br />No reconsideration. <br />25.Reconsider Ordinance 2013 -38, amending the Official Zoning Map of the City by <br />rezoning 20.08 acres of land, more or less, out of the T.J. Chambers Survey, Abstract <br />No.2, located at Lime Kiln Road and Windemere Road from FD Future Development <br />District to SF -R Rural Residential District; and including procedural provisions. <br />No reconsideration. <br />26.Consider approval of Ordinance 2013 -43, on the first of two readings, amending <br />Chapter 62, Article 3, Division 1 of the San Marcos City Code, by adding a new Section <br />62.187 to authorize the payment of assignment pay in the amount of $300 per month for <br />Fire Department personnel assigned by the Fire Chief as Support Services Officer or <br />Training Coordinator; providing a savings clause; providing for the repeal of any <br />conflicting provisions; and providing an effective date. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Porterfield, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2013 -43, on the first of two readings, as previously captioned.
