MOTION: Upon a motion made by Council Member Becak and a second by Council Member Scott, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2013 -40. The motion carried unanimously. 21.7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2013 -41, amending the Official Zoning Map of the City by rezoning 1.75 acres of land, more or less, being Lot 5 -B, San Marcos Medpark Subdivision, located at 1902 Medical Parkway, from OP Office Professional District to GC General Commercial District; including procedural provisions; and consider approval of Ordinance 2013 -41. Matthew Lewis, Director of Development Services, provided a brief presentation. Mayor Daniel Guerrero opened the public hearing at 7:23 p.m. Edward. Johnson spoke in favor of this item and asked the Council for positive consideration. The motion carried. 22.7:OOPM Receive a Staff presentation and hold a Public Hearing to receive comments for or against Ordinance 2013 -42, amending Section 1.5.1.4 (g) of the City's Land Development Code to establish a one -year waiting period before zoning amendments may be considered again after the applicant has withdrawn the same requested change or modified the boundary of the parcel of land subiect to the same requested change; providing a savings clause; providing for the _repeal of any _conflicting provisions; and providing an effective date; and consider approval of Ordinance 2013 -42, on the first of two readings. Mayor Daniel Guerrero opened the public hearing at 7:38 p.m. There being no comments; the public hearing was closed at 7:38 p.m. MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Thomaides, MOTION TO AMEND: Upon a motion made by Council Member Porterfield and a second by Council Member Becak, the City Council voted six (6) for and one (1) opposed, Council Member Scott, to amend Section 1 (g) (2) to state, "withdrawal of the same requested change by the applicant after the city council meeting at which the change is to be considered has been called to order," and (g) (3) to state, "a change to the boundary of the same requested change by the applicant after the Planning and Zoning Commission has voted on the matter."
