<br />(3) Payments by the parties for services under this Agreement shall be made from <br />current revenues available to the parties. <br />(4) If the City has not established that tax rate as required by law for that City <br />within thirty-five (35) days after the Central Appraisal District Appraisal Review board <br />has certified to the City the assessed values on the property in the City but in no event <br />earlier than the first regularly scheduled meeting of the City in September, then this <br />Agreement becomes voidable by action of the County. The County may then declare this <br />Agreement null and void by written notice from the Tax Assessor-Collector. <br />(5) Hays County has adopted a partial payment program on delinquent taxes and, <br />additionally, offers a split payment option on current taxes as defined by Section 31.03, <br />Texas Property Tax Code. The City hereby authorizes the County to offer the same <br />payment programs in collecting City taxes. <br />(6) Authorized refunds to property owners will be made on the same check for all <br />taxing units contracting for assessment and collection services. Such changes include, but <br />are not limited to, late exemption claims, clerical errors, overpayments, etc. The amount <br />of the City's refund shall be deducted from collections withheld or, if none are available, <br />shall be remitted by the City of the County within seven (7) days of notification of such <br />sums due. All refunds shall be made in accordance with the City Charter and Section <br />31.11, Texas Property Tax Code. <br /> G. DELINQUENT TAXES <br />1. Collection of Delinquent Taxes. <br /> (A) Pursuant to Section 6.24 of the Texas Property Tax Code, the City hereby <br />authorizes the County by and through the County's Tax Assessor-Collector to collect <br />delinquent taxes for the City as the County deems necessary. <br /> (B) Pursuant to Section 6.30 of the Texas Property Tax Code, the City hereby <br />agrees and expressly authorizes the County to contract on the- City's behalf with private <br />legal counsel for the collection of delinquent taxes. The City further agrees that such <br />fee as is allowed by law and provided in the contract with private legal counsel will <br />
