<br /> Exhibit IIBII - Page 2 of 2 <br /> -2- <br /> provided construction has been completed <br /> within such one-year period and in accordance <br /> with approved construction plans, reimburse <br /> the subdivider for any increased cost of such <br /> facilities. <br /> Before any subdivider shall be entitled to <br /> reimbursement of any funds, he shall furnish <br /> the city with a signed copy of the bid <br /> tabulation sheet which has been accepted by <br /> him for construction of the improvements for <br /> which the reimbursement is to be made, as <br /> well as a copy of the construction contract <br /> between such subdivider and the contractor. <br /> 4. Maintenance of Roads and streets: <br /> There are no roads or streets that will be maintained by <br /> the City of San Marcos. Parking lots cover almost all <br /> of the driving area. Entrances and exits, parking lots, <br /> and lighting will be maintained by the property owners. <br /> 5. Solid Waste Collection: <br /> The property owners or occupants must contract with a <br /> private waste collection company for waste disposal. <br /> (The City of San Marcos does not provide waste disposal <br /> service to commercial establishments.) <br /> 6. Maintenance of Public Parks, Playgrounds, Swimminq <br /> Facilities, and any other Parks and Recreation DeDartment <br /> facility or buildinq dedicated to the Dub1ic: <br /> The same standards and pol icies now established and in <br /> force within the city limits will be followed in <br /> maintaining and expanding public facilities. (No public <br /> facilities are incorporated in this property at this <br /> time.) <br /> 7. CaDital ImDrovements: <br /> There are no capital improvements planned through Fiscal <br /> Year 1995 for this property outside of those presently <br /> under construction by the property owners. All immediate <br /> improvements and infrastructure are the responsibility <br /> of the property owners. Upon completion of the water <br /> and sewer facilities and acceptance by Elim Water <br /> Company and the City, respectively, these improvements, <br /> within dedicated rights-of-way and easements, will <br /> become the maintenance responsibility of Elim Water <br /> Company and the City, respectively. <br />
