<br /> 3 <br /> Council consisting of nine (9) voting members shall be formed to <br /> serve as an advisory committee to the Chamber and funds allocated <br /> to the Chamber from this Agreement shall be expended only with the <br /> advice and consent of this Council. The members of this Council <br /> shall be selected as follows: two (2) members appointed by the San <br /> Marcos Chamber of Commerce, two (2) members appointed by the <br /> Hispanic Chamber of Commerce, two (2) members appointed by the City <br /> Council, one (1) member appointed by the Hotel Motel Association, <br /> one (1) member appointed by the Heritage Association and one (1) <br /> member representative of the Arts community to be selected by the <br /> City Council. The City Manager of the City and the President of <br /> the Chamber or their designees shall be non-voting, ex-officio <br /> members of the Convention and visitors Bureau Council. <br /> 4. <br /> FUNDING FOR THE ARTS <br /> The City specifically stipulates and the Chamber hereby agrees <br /> that at least Fifteen Thousand Dollars ($15,000) or one half (1/2) <br /> of one per cent (1%) of the annual amount of all funds collected by <br /> City and paid to Chamber under this Agreement from the hotel <br /> occupancy tax, whichever is greater, will be allocated by the <br /> Chamber annually to funding for the arts as set out in Section 26- <br /> 21(d) of the Code of Ordinances of the city. However, under no <br /> circumstances will more than fourteen per cent (14%) of the funds <br /> paid to the Chamber under this Agreement be allocated for these <br /> purposes, nor will any funds be awarded to any taxing unit as that <br /> phrase is defined in section 1.04 of the Texas Tax Code. <br />
