CODE OF ORDINANCES PERTAINING TO THE REGULATION OF <br />SIGNS; PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR PENALTIES; <br />PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE <br />DATE. <br /> <br /> <br /> <br />WHEREAS, the purposes of the regulations contained in this <br />ordinance include the following: <br />l~ <br />::- To authorize signs which are compatible with their <br />~ surroundings, appropriate to the activity to which they <br />",i pertain, provide identification for their users and convey <br />t~ information to the public; <br /> <br />To prohibit signs which interfere with scenic views, detract <br />from property values, endanger the public health or safety, <br />~ or otherwise constitute a nuisance with respect to the <br />!: aesthetic standards and social values of the community; and <br /> <br />;.- To encourage effective advertising and the voluntary <br />reduction of nonconforming signs; now therefore, <br /> <br />IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> <br />SECTION 1. That Appendix B, San Marcos Sign Ordinance of the San <br />Marcos Code of Ordinances, is hereby amended to read as follows: <br /> <br />APPElIDIX B. SIGHS <br /> <br />AR~ICLE I. GEIŒRAL PROVISIONS <br /> <br /> <br />See. 1-1. Jurisdiction. <br /> <br />These regulations shall govern all signs within the city limits, <br />and all off-premise signs within the extraterritorial jurisdiction <br />of the city. <br /> <br />See. 1-2. Applicability. <br /> <br />All signs shall be erected, displayed, altered and reconstructed <br />in conformance with the provisions of this Chapter. Where the <br />requirements of this Chapter for a particular sign are different <br />than comparable requirements contained in any other law, <br />ordinance, or regulation, the requirements and standards which are <br />more restrictive shall apply. <br /> <br />See. 1-3. ExelDpted Signs. <br /> <br />The following signs shall be exempt from all provisions of this <br />Chapter except those contained in this article: <br /> <br />(1) Signs which are not visible from the nearest public <br />street toward which they are oriented. <br /> <br />( 2 ) Temporary window displays consisting of merchandise or <br />posters. <br /> <br />(3) National, state or other governmental flags; and all <br />other flags up to 60 square feet in area. <br /> <br />(4) Pennants and streamers; and balloons not exceeding 36 <br />inches in greatest dimension. <br />
