<br /> 8l <br /> ^'- <br /> ORDINANCE 1990- 83 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING CHAPTER TWO OF <br /> THE SAN HARCOS CODE OF ORDINANCES TO ESTABLISH <br /> GENERAL POLICIES PERTAINING TO CITY BOARDS AND <br /> COMMISSIONS; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES AND <br /> RESOLUTIONS; PROVIDING A PENALTY; PROVIDING <br /> FOR PUBLICATION; AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, City Boarès and Commissions are governed by <br /> administrative rules and re;;lllatiOi¡,sl~lat have been adopted over <br /> time in a variety of ordinances and res~lutions; and, <br /> WHEREAS, the efficient ope~z.tion of City Boards and <br /> Conanissions requires t:l\at thE~SG. rules and regulations be <br /> reorganized and adopted in a single ordinance to be published in <br /> the San Marcos Code of Ordinances; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. 'fhat Article IV of Chapter 2, Administration, of <br /> the San Marcos Code of Ordinances is hereby amended to read as <br /> follows: <br /> ARTICLE IV. GENERAL POLICIES FOR CITY <br /> BOARDS AND COMMISSIONS <br /> Sec. 2-53. Open Meetinqs. <br /> <br /> All boards and commissions of the City whose membership is <br /> wholly appointed by the City Council shall comply with the <br /> standards for open meetings as prescribed by State law for <br /> members of governmental bodies. <br /> Sec. 2-54. Membershio on More Than One Board or Commission. <br /> A person may not be appointed as a member of more than one <br /> permanent City board or commission, except where duplicate <br /> appointments are authorized by ordinance, the City Charter, <br /> or State law. <br /> Sec. 2-55. Limitation on Successive Terms of Office. <br /> (a) A person may not be appointed to a term of office on <br /> a City board or commission if the person has served two (2) <br /> consecutive terms of office on the board or commission <br /> immediately prior to the term for which the appointment is <br /> being considered. <br /> (b) For purposes of this section, a person shall be deemed <br /> to have served a term of office on a board or commission if <br /> the person serves more than one-half of a regular term of <br /> office on the board or commission. <br /> (c) This section shall not apply to appointments to boards <br /> and commissions to which the City exercises appointment <br /> authority over only one (1) position, or to appointments to <br /> boards and commissions where limitations on successive terms <br /> of office different from those prescribed herein are <br /> specifically established by ordinance, the City Charter, or <br /> State law. <br /> (d) This section shall not apply where good cause exists <br /> to appoint a person for a third consecutive term. For this <br /> purpose, good cause shall include, but not be limited to, <br />
