That Chapter 3, Animals and Fowl, of the San <br /> &' Code of Ordinances is amended to read as follows: <br /> ~ <br /> - <br /> CHAPTER 3. ANIMALS AND FOWL <br /> ARTICLE I. IJ;i GENERAL <br /> <br /> Sec. 3-1. Oefinitiouso <br /> As used in this chapter, the following terms shall have <br /> the respective meanings ascribed to them: <br /> Animal: Any vertebrate creature, whether domestic or <br /> wild. <br /> Animal Control Officer: Any person designated by the <br /> City of San Marcos to enforce city ordinances and state <br /> laws pertaining to animals. <br /> Animal Shelter: Any facility operated by the city or a <br /> humane society for the purpose of impounding or caring <br /> for animals under the authority of this chapter or state <br /> law. <br /> Auction: Any place or facility where animals are <br /> regularly bought, sold, or traded, except for such <br /> facilities which are otherwise defined in this chapter or <br /> state law. This section does not apply to individual <br /> sales of animals by owners. <br /> Circus: A commercial variety show featuring animal acts <br /> for public entertainment. <br /> Commercial Animal Establishme~t: Any pet shop, grooming <br /> shop, auction, riding school or stabìe, zoological park, <br /> kennel or small animal facility, guard dog or obedience <br /> training center, circus or performing anímal exhíbition. <br /> This term shall not include animal shelters or veterinary <br /> hospitals, as those. terms are herein defined. <br /> Fowl.;.. Includes chickens, turkeys, pheasants, ducks, <br /> geese, pigeons and all similar domestic birds and <br /> poultry, whether kept for use or pleasure. <br /> Grooming Shop: Any facility where animals are bathed, <br /> clipped, plucked or otherwise groomed. <br /> Handler: Any person having immediate responsibilit~ for <br /> control of an animal. <br /> Kennel: Any facility used for the business of boarding, <br /> breeding, or training dogs or cats for a fee. <br /> Livestock: Includes horses, mules, donkeys, cattle, <br /> sheep, goats, hogs, and all similar domestic animals, <br /> whether kept for use or pleasure. <br />
