<br /> 12 <br /> (f) The owner of any animal quarantined in the city animal <br /> shelter shall pay an observation fee as set by city council <br /> by separate ordinance from time to time, in addition to all <br /> impoundment fees assessed under Section 3-42, regardless of <br /> the ultimate disposition of the animal. <br /> Sec. 3-60. Disposition of quarantined animals. <br /> <br /> (a) If it is determined by a veterinarian that a <br /> quarantined animal shows the clinical signs of rabies, the <br /> local health authority shall humanely destroy the animal. <br /> (b) If the animal dies or is destroyed while in <br /> quarantine, the health authority shall submit the head or <br /> brain of the animal for testing to the nearest laboratory of <br /> the state department of health. <br /> (c) The local health authority shall direct the <br /> disposition of any animal found to be infected with rabies. <br /> (d) If it is determined by a veterinarian that a <br /> quarantined animal does not show the clinical signs of <br /> rabies at the end of the quarantine period, the local health <br /> authority shall release it to the owner if: <br /> (I) The owner has a current, valid rabies vaccination <br /> certificate for the animal; or, <br /> (2) The animal is vaccinated against rabies by a <br /> licensed veterinarian at the owner's expense at <br /> the conclusion of the quarantine. <br /> Sec. 3-61. Animals constituting imminent danger. <br /> <br /> Any animal that is or appears to be rabid constituting an <br /> imminent danger to any person or to any other animal may be <br /> immediately exterminated by a police or animal control <br /> officer. <br /> Sec. 3-62 - 3-69. Reserved. <br /> ARTICLE VII. MISCELLANEOUS PROVISIONS <br /> Sec. 3-70. Aaitation of Dolice doas Þrohibited. <br /> <br /> No person shall harass, tease or othe~wise agitate any dog <br /> working for the San Marcos Police Department or any other <br /> law enforcement agency. <br /> Sec. 3-71. Acts of cruelty or harassment directed at horses <br /> of the mounted Þolice prohibited. <br /> <br /> No person shall strike, prod, injure, threaten or <br /> frighten, a horse, whether mounted or unmounted, which is in <br /> use on official duties by a law enforcement officer. Any <br /> physical action by a law enforcement officer to use, direct, <br /> or control hi s mount shall not be an offense under this <br /> section. <br /> Sec. 3-72. Compliance with this chaÞter. <br /> <br /> The keeping of any animal in accordance with the <br /> provisions of this chapter shall not be construed to <br /> authorize the keeping of the animal in violation of the <br /> zoning ordinance or any other ordinance of the city. <br /> SECTION 2.
