<br /> 8 <br /> c::> <br /> -.-s- <br /> .,ç:- <br /> -,-~.- <br /> ORDINANCE 1990- 91 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL <br /> ZONING MAP OF THE CITY BY ZONING A 20,606.511 <br /> SQUARE FOOT TRACT OF LAND, BEING PARTS OF LOTS <br /> 12 AND 13, BLOCK 6 OF THE ORIGINAL TOWN OF SAN <br /> MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN <br /> VOLUME 46, PAGE 448 OF THE HAYS COUNTY DEED <br /> RECORDS, LOCATED AT 112 C.M. ALLEN PARKWAY <br /> FROM "I" INDUSTRIAL DISTRICT TO "c" COMMERCIAL <br /> DISTRICT AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, on October 2,1990, the Zoning Commission of the city <br /> of San Marcos held a public hearing regarding a request to change <br /> the zoning from "I" Industrial District to "C" Commercial District <br /> of a 20,606.511 square foot tract of land, being parts of Lots 12 <br /> and 13, Block 6 of the Original Town of San Marcos, Hays County, <br /> Texas, and, <br /> WHEREAS, subsequent to the public hearing on that date, the <br /> Zoning Commission did, on October 2,1990, consider the request and <br /> voted to approve it and has recommended that the request be <br /> approved by the City Council of the City; and, <br /> WHEREAS, the City Council held a public hearing on the 10th <br /> day of December , 1990, regarding the request; and, <br /> WHEREAS, all requirements of Appendix A, General Zoning <br /> Ordinance, of the Code of Ordinances of the City of San Marcos <br /> pertaining to amendments have been met; and, <br /> WHEREAS, the city Council hereby finds and determines that the <br /> adoption of the following ordinance is in the interest of the <br /> public health, morals, welfare and safety; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That the Official Zoning Map of the City, as <br /> described in Section 3 of the General Zoning Ordinance is hereby <br /> amended to rezone the following described real property located in <br /> San Marcos, Hays County, Texas, which is presently zoned "I" <br /> (Industrial District) to "C" (Commercial District): <br /> A 20,606.511 square foot tract of land, being parts of <br /> Lots 12 and 13, Block 6 of the Original Town of San <br /> Marcos, Hays County, Texas, as recorded in Volume 46, <br /> page 448 of the Deed Records of Hays County, Texas, more <br /> particularly described by metes and bounds as follows: <br /> BEGINNING at an iron pin set at the intersection of the <br /> west boundary of C.M. Allen with the north boundary of <br /> Comal Street for the southeast corner of the herein <br /> described tract, this also being the southeast corner of <br /> a 6097.704 square foot tract conveyed by the City of San <br /> Marcos; <br /> THENCE along the north boundary of Comal Street, S 800 <br /> 35' W, passing an iron pin set for the southwest corner <br /> of the above mentioned 6097.704 square foot tract and the <br /> southeast corner of the former Leo P. Cloud, Jr., and Son <br /> property as described in Volume 282, page 152 of the Deed <br /> Records of Hays County, Texas and continuing for an <br /> additional 125.00 feet, l50.00 feet in all, to an iron <br /> pin at the intersection of the east boundary of <br /> Callihan's Alley with the north boundary of Comal Street, <br /> this also being the southwest corner of the said Leo P. <br />
