<br />r~ <br />'~ 25 <br />0- <br />ër <br />- <br /> <br />~ - <br />""'"- <br />ORDINANCE 1990- 99 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REVISING CHAPTER 15, LIBRARY, OF THE <br />SAN MARCOS CODE OF ORDINANCES TO PROVIDE FOR CERTAIN <br />SERVICE FEES TO BE SET BY THE CITY COUNCIL; SETTING <br />THE AMOUNTS OF THESE FEES; REVISING PROVISIONS <br />PERTAINING TO TERMS OF OFFICE OF LIBRARY BOARD <br />MEMBERS; REQUIRING AN ANNUAL REPORT FROM THE BOARD <br />TO THE CITY COUNCIL; PROVIDING FOR SEVERABILITY; <br />REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br />PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That section 15-1 of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />Sec. 15-1. Fees and charges for library services. <br /> <br />(a) Use of the San Marcos Public Library shall be free of <br />charge to all residents of the City of San Marcos and Hays <br />County, subject only to such fees and charges are <br />specifically authorized in this Chapter. <br /> <br />(b) A library card shall be required of each person who <br />desires to be loaned materials and equipment. The initial <br />library card for residents of the City and Hays County is <br />free of charge. A fee set by separate ordinance shall be <br />charged to replace each lost library card. <br /> <br />(c) Out-of-county residents shall be charged an annual fee <br />set by separate ordinance for a library card. <br /> <br />(d) Charges for lost òr irreparably damaged library <br />materials shall include the replacement cost of the <br />materials as determined by the library director, plus a <br />service charge set by separate ordinance. <br /> <br />(e) Charges for damaged but repairable library materials <br />shall be based on the cost of repairing the materials, as <br />determined by the library director. <br /> <br />SECTION 2. That Section 15-20 of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />Sec. 15-20. Oualification of members. <br /> <br />At least five (5) members of the library board shall be <br />residents of the city. <br /> <br />SECTION 3. That section 15-22 of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> <br />Sec. 15-22. Terms of members. <br /> <br />(a) The terms of office of members of the library board <br />shall be two (2) years and shall begin on October 1 of the <br />year of appointment. The terms shall be staggered so that <br />the terms of four (4) members shall expire in odd-numbered <br />years, and the terms of three (3) members shall expire in <br />even-numbered years. <br /> <br />(b) Notwithstanding subsection (a) above, library board <br />members shall continue in office until their successors are <br />duly qualified. <br />
