r~ '~ 25 0- ër - ~ - ""'"- ORDINANCE 1990- 99 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, REVISING CHAPTER 15, LIBRARY, OF THE SAN MARCOS CODE OF ORDINANCES TO PROVIDE FOR CERTAIN SERVICE FEES TO BE SET BY THE CITY COUNCIL; SETTING THE AMOUNTS OF THESE FEES; REVISING PROVISIONS PERTAINING TO TERMS OF OFFICE OF LIBRARY BOARD MEMBERS; REQUIRING AN ANNUAL REPORT FROM THE BOARD TO THE CITY COUNCIL; PROVIDING FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That section 15-1 of the San Marcos Code of Ordinances is hereby amended to read as follows: Sec. 15-1. Fees and charges for library services. (a) Use of the San Marcos Public Library shall be free of charge to all residents of the City of San Marcos and Hays County, subject only to such fees and charges are specifically authorized in this Chapter. (b) A library card shall be required of each person who desires to be loaned materials and equipment. The initial library card for residents of the City and Hays County is free of charge. A fee set by separate ordinance shall be charged to replace each lost library card. (c) Out-of-county residents shall be charged an annual fee set by separate ordinance for a library card. (d) Charges for lost òr irreparably damaged library materials shall include the replacement cost of the materials as determined by the library director, plus a service charge set by separate ordinance. (e) Charges for damaged but repairable library materials shall be based on the cost of repairing the materials, as determined by the library director. SECTION 2. That Section 15-20 of the San Marcos Code of Ordinances is hereby amended to read as follows: Sec. 15-20. Oualification of members. At least five (5) members of the library board shall be residents of the city. SECTION 3. That section 15-22 of the San Marcos Code of Ordinances is hereby amended to read as follows: Sec. 15-22. Terms of members. (a) The terms of office of members of the library board shall be two (2) years and shall begin on October 1 of the year of appointment. The terms shall be staggered so that the terms of four (4) members shall expire in odd-numbered years, and the terms of three (3) members shall expire in even-numbered years. (b) Notwithstanding subsection (a) above, library board members shall continue in office until their successors are duly qualified.
