<br /> SECTION 4. That section 15-26 of the San Marcos Code of <br />Ordinances is hereby amended to read as follows: <br /> Sec. 15-26. Re'Dorts. <br /> <br /> The library board shall present an annual report to the <br /> city council pertaining to the operations and activities of <br /> the Public Library and of the library board. <br /> SECTION 5. That the following fees and charges related to the <br />San Marcos Public Library are hereby established: <br />DescriDtion city Code Reference Amount <br /> <br />Replace library card Sec. 15-1(b) $ 2.00 <br />Out-of-county resident Sec. 15-1(c) $12.00 <br />library card <br />Service charge-lost Sec. 15-1(d) $ 4.00 <br />or damaged materials <br /> SECTION 6. That the provisions of section 15-22(a) as amended <br />in section 1 of this ordinance shall not apply to the terms of <br />current members of the library board, but shall apply to the terms <br />of all members appointed after the effective date of this <br />ordinance. <br /> SECTION 7. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance sha:).l remain in effect as if the <br />unconstitutional or invalid portion had not been adopted. <br /> SECTION 8. That all ordinances and resolutions or parts of <br />ordinances or resolutions in conflict herewith are hereby repealed. <br /> SECTION 9. That any person violating any provision of this <br />ordinance shall be deemed guilty of a misdemeanor and upon <br />conviction shall be subject to the penalty provided in Section 1-5 <br />of the San Marcos Code of Ordinances. <br /> SECTION 10. That this Ordinance shall be in effect ten (10) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the city of San Marcos, Texas. <br /> PASSED AND APPROVED on first reading November 26, 1990. <br /> PASSED AND APPROVED on second reading December 10, 1990. <br /> PASSED, APPROVED AND ADOPTED <br />Attest: ~ ~ <br />~~ýM <br />Janis K.
