Hopkins <br />San Marcos, TX 78666 <br />Dear Mr. Gilley: <br />Pursuant to the requirements of the contract documents for construction of the Functional Replacement of <br />Gary Job Corps Facilities, I have prepared this certificate of substantial completion for the project, with an <br />effective date of December 4, 1990. <br />The project has been subjected to a series of previous inspections for completeness and compliance with <br />the plans and specifications; and the contractor has corrected discrepancies or incomplete work noted <br />during those inspections. <br />Under the terms of the contract documents, the City of San Marcos has seven days in which to make a <br />written objection to the architect as to any provisions of this certificate; should the City of San Marcos have <br />any reason for objecting to this certification, I request that you advise me at your earliest possible time so <br />that we can address any such issue immediately. <br />The contractor has delivered all maintenance and operating instructions, schedules, guarantees, testing <br />and balancing reports and other documents as required by the specifications, and has submitted an <br />application for final payment. The contractor has also provided releases in full and an affidavit that <br />releases receipts include all labor, services, material and equipment for which a lien could be filed, and that <br />all payrolls material, equipment bills and other expenses connected with the work for which the City might <br />be responsible have been paid, or otherwise satisfied. <br />Based upon our review of the contractor's performance, and inspection of the facilities and work <br />accomplished, and the documents submitted under the terms of the contract documents, it is our <br />recommendation that the contractor be paid in full, less the amount withheld for liquidated damages, <br />11,632.85. This amount will be used to offset additional expense incurred by the City for additional <br />inspection services and related costs. The contractor's application for final payment has been approved <br />by me and is transmitted with this letter. It should be noted that the contractor has continuing obligations <br />under this contract for warranties and performance of the facilities and equipment and that this <br />recommendation for payment and certificate of substantial completion does not relieve the contractor in any <br />way for work that is not in accordance with the contract documents. <br />Further, acceptance of the payment recommended shall constitute a waiver of all claims by the contractor <br />against the owner, other than those previously made in writing and still unsettled. We are not aware of any <br />such claims. <br />
