Legislation to ensure minimum stream flows and to protect <br /> water quality in Texas rivers from degradation caused by <br /> over-appropriation of water rights for municipal, industrial, <br /> and irrigation uses, aquifer depletion and contaminated run- <br /> off; establishing a process for designation and management of <br /> scenic and recreational rivers. <br />16. Legislation to amend the Texas Alcoholic Beverage Code to <br /> create a mandatory requirement that TABC license or permit <br /> holders verify the age of persons to whom they sell or serve <br /> alcoholic beverages through a check of valid legal <br /> identification. <br />Legislation the City of San Marcos will OPPOSE: <br />1. Legislative initiatives by private entities that would impede <br /> or restrict provision of public sector recreation services. <br />2. Legislation eliminating or limiting the original jurisdiction <br /> of municipalities to regulate the rates, terms of service and <br /> capital investments of municipally owned water and wastewater <br /> utilities. <br />3. Legislation limiting municipalities current rights regarding <br /> promulgation of consent agreements during creation of water <br /> districts or adversely affecting the validity of terms and <br /> conditions of the consent agreements once the water districts <br /> are formed. <br />4. Legislation increasing state regulation of city-owned <br /> electric utilities or diminishing the city's ability to <br /> direct utility operations and set electric rates. <br />5. Legislation that would restrict or remove a city's existing <br /> powers to regulate land use and development in its <br /> jurisdiction; reduce a city's existing full and limited <br /> purpose corporate boundaries or the area of its <br /> extraterritorial jurisdiction; establish new rights of áppeal <br /> of City Council actions relating to land use or development <br /> to state agencies or other political subdivision of the <br /> State; or impose additional requirements or limitations with <br /> respect to annexation of territory. <br />
