<br />36 <br /> <br />STATE OF TEXAS <br /> <br />LEASE AMENDMENT <br />NUMBER THREE TO GT+3 <br />FLIGHT OPERATIONS LEASE <br />OF SEPTEMBER 9, 1980 <br /> <br />COUNTY OF CALDWELL <br /> <br />CITY OF SAN MARCOS <br /> <br />Whereas, by execution of a lease agreement on September 9, <br />1980, the City of San Marcos, Texas, hereinafter referred to as <br />"City" did enter into an agreement for the lease of a portion of <br />the San Marcos Municipal Airport to GT+3 Flight Operations, <br />hereinf\f.ter referred to as "Flight Operations," for the conduct of <br />a non-exclusive and non-discriminatory FBO operation; and <br /> <br />Whereas, City desires to construct a new airport terminal <br />building on a portion of the premises leased to Flight Operations <br />pursuant to said lease; and <br /> <br />Whereas, in order to facilitate the construction of the new <br />terminal building, it is necessary to temporarily relocate Flight <br />Operations, and Flight Operations will be permanently relocated to <br />the new terminal building; now, therefore, <br /> <br />It is understood and agreed by the parties hereto that the <br />following amendments are incorporated into said lease agreement <br />and are subject to the terms and provisions of said lease <br />agreement except as stated below: <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Paragraph I of said lease, as amended, is hereby <br />rescinded and the following substituted in its place: <br /> <br />I. <br /> <br />City hereby leases to Flight Operations the below-described <br />premises at Airport: <br /> <br />A. <br /> <br />Prior to Completion of the New Terminal Building. <br /> <br />Beginning March 15 , <br /> <br />1989, or any other mutually agreeable <br /> <br />time, Flight Operations shall quit and surrender possession of the <br /> <br />demised <br /> <br />premises <br /> <br />described <br /> <br />in Amendment <br /> <br />No. <br /> <br />2 <br /> <br />to <br /> <br />said <br /> <br />lease <br /> <br />agreement and City shall lease to Flight Operations and Flight <br /> <br />Operations shall relocate to temporary facilities sufficient to <br /> <br />permit Flight Operations to carry on its day-to-day operations as <br /> <br />a full service FBO in substantially the same manner as before the <br /> <br />relocation. <br /> <br />Prior <br /> <br />to <br /> <br />the <br /> <br />surrender <br /> <br />of <br /> <br />the <br /> <br />demised <br /> <br />premises <br /> <br />described <br /> <br />in Amendment No. <br /> <br />2 <br /> <br />to <br /> <br />said <br /> <br />lease <br /> <br />agreement, <br /> <br />Flight <br /> <br />Operations has the exclusive right of salvage to all property, <br /> <br />equipment, <br /> <br />and fixtures that Flight Operations has installed or <br /> <br />added to the premises during the duration of the lease agreement. <br /> <br />Said <br /> <br />temporary <br /> <br />facilities <br /> <br />will <br /> <br />consist, <br /> <br />at <br /> <br />a <br /> <br />minimum, <br /> <br />of <br /> <br />a <br /> <br />partitioned <br /> <br />trailer <br /> <br />or <br /> <br />equivalent <br /> <br />temporary <br /> <br />building <br /> <br />with <br /> <br />restrooms, office and lounge areas, and space for an operations <br /> <br />counter. <br /> <br />Said temporary facilities will be located in the general <br /> <br />-1- <br />
