<br />vicinity of the current terminal building formerly occupied by <br /> <br />Flight <br /> <br />Operations <br /> <br />under <br /> <br />this <br /> <br />lease. <br /> <br />City <br /> <br />will, <br /> <br />within <br /> <br />180 <br /> <br />consecutive days, or less, after March 15, <br /> <br />1989, or such other <br /> <br />mutually agreeable date as the parties may determine, construct <br /> <br />and complete the new terminal building. <br /> <br />However, City shall not <br /> <br />be responsible <br /> <br />for any delays which are caused by actions <br /> <br />or <br /> <br />events <br /> <br />bevond <br /> <br />its <br /> <br />control, <br /> <br />except <br /> <br />that <br /> <br />it <br /> <br />shall <br /> <br />continue <br /> <br />to <br /> <br />provide Flight Operations said temporary facilities. <br /> <br />B. <br /> <br />After completion of the New Terminal Building. <br /> <br />Upon determination by Ci ty that construction <br /> <br />of <br /> <br />the new <br /> <br />terminal building is complete, Flight Operations shall quit and <br /> <br />surrender <br /> <br />possession of <br /> <br />the <br /> <br />temporary <br /> <br />facilities <br /> <br />described <br /> <br />in <br /> <br />Section <br /> <br />lA, <br /> <br />above, <br /> <br />and Ci ty shall <br /> <br />lease exclusively to Flight <br /> <br />Operations <br /> <br />and Flight Operations <br /> <br />shall relocate to an area of <br /> <br />approximately 900 sq. ft. <br /> <br />of operating space in the new terminal <br /> <br />building, substantially as reflected on Exhibit 3 attached hereto, <br /> <br />and to be more particularly described in a drawing which will be <br /> <br />attached <br /> <br />to <br /> <br />this <br /> <br />lease <br /> <br />as <br /> <br />"Replacement <br /> <br />Exhibit <br /> <br />3" <br /> <br />after <br /> <br />construction of the new terminal building is completed and Flight <br /> <br />Operations <br /> <br />has <br /> <br />relocated. <br /> <br />Replacement <br /> <br />Exhibit <br /> <br />3 <br /> <br />will <br /> <br />be <br /> <br />incorporated into this lease amendment and made a part hereof for <br /> <br />all purposes. <br /> <br />The leased premises in the new terminal building <br /> <br />will be finished out by the City in substantially the same manner <br /> <br />as <br /> <br />the other areas <br /> <br />of the building with painted walls, <br /> <br />floor <br /> <br />covering, ceiling, and electrical fixtures. <br /> <br />In addition, Flight <br /> <br />Operations shall have non-exclusive access to the common areas of <br /> <br />the terminal building. <br /> <br />In particular, Ci ty shall provide in the <br /> <br />new terminal building a flight service phone and planning area, <br /> <br />restrooms for men and women, an area where airport patrons and <br /> <br />their guests may purchase and consume food and drink, a meeting <br /> <br />room, and a lounge area. <br /> <br />The parties hereto understand that the terminal building will <br /> <br />be owned, <br /> <br />controlled, and maintained by City and that City may <br /> <br />from time to time institute policies which will facilitate its <br /> <br />control <br /> <br />and <br /> <br />maintenance. <br /> <br />However, <br /> <br />no <br /> <br />such <br /> <br />policies <br /> <br />will <br /> <br />be <br /> <br />instituted which will unreasonably interfere with Flight <br /> <br />-2- <br />
