<br /> 92 <br /> INTERLOCAL COOPERATION AGREEMENT <br /> An agreement among political subdivisions of the State <br /> of Texas to undertake a cooperative effort to develop a <br /> program to properly manage the waters of the Edwards <br /> Aquifer. <br /> WHEREAS, the availability of a water supply of adequate <br />quantity and quality is essential for all purposes, including <br />municipal, agricultural, industrial, environmental and <br />recreational; and <br /> WHEREAS, the Edwards Aquifer is a major and in some instances <br />sole source of water for a significant area of Texas; and <br /> WHEREAS, the continuous and sustained withdrawal of <br />groundwater from the Edwards Aquifer in excess of the average <br />annual recharge will do substantial injury to the Edwards Aquifer <br />and the general economy and welfare of this State; and <br /> WHEREAS, proper management of the Edwards Aquifer requires the <br />implementation of a regulatory management program which will <br />prevent overdrafting and non-degradation of water of the Edwards <br />Aquifer; and <br /> WHEREAS, such a management program must take into account and <br />protect existing water uses, including spring flows from the <br />Edwards Aquifer, and at the same time, consider the future needs <br />and demands of the area; and <br /> WHEREAS, legislation is needed in order to property implement <br />such regional water planning and management; and <br /> WHEREAS, there are multiple political subdivisions which are <br />interested in implementation of such a management program; and <br /> WHEREAS, each of the parties hereto has the independent <br />authority acting individually to engage in the purposes authorized <br />by this Agreement, including without limitation efforts to <br />influence the passage of legislation; and <br /> WHEREAS, experience has shown that a cooperative effort <br />between political subdivisions with a common goal is effective in <br />leading to an implementation of such a management program; and <br /> WHEREAS, only political subdivisions may enter into this <br />Agreement; and <br /> - 1 - <br />56220 <br />
