Gilley, City Manager <br /> FROM: Gayle Mallia Grassle <br /> Assistant City Attorney <br /> UBJECT: Certificates of Credit in Exchange for <br /> DATE: April 7, 1989 <br /> After the Council authorizes you to issue certificates of credit, <br /> we will need to implement some sort of internal policy so that the <br /> City will have accurate records of these transactions. May I <br /> suggest the following procedures? <br /> To issue a certificate: <br /> I. The department negotiating the exchange of a certificate <br /> of credit for an easement should request the Legal <br /> Department to prepare the easement deed and certificate <br /> of credit simultaneously after obtaining the City <br /> Manager's approval. An appraisal or other verification <br /> of the property value should accompany the request. <br /> 2. The Legal Department should prepare the easement deed <br /> and certificate of credit and forward them to the City <br /> Manager for execution. <br /> 3. The City Secretary should attest and seal the <br /> certificate and return both the original easement deed <br /> and certificate of credit to the legal department. <br /> 4. The Legal Department should take measures to have the <br /> easement deed executed and recorded at the Courthouse <br /> and to have the certificate of credit issued to the <br /> grantor. <br /> 5. After the easement deed is recorded in the Hays County <br /> Real Property Records, the Legal Department should make <br /> a notation of the volume and page number on copies of <br /> the certificate of credit and copies of same should be <br /> distributed to and maintained in the Legal Department, <br /> Public Works Department and City Secretary's Office. <br /> 6. A log book listing the certificates in numerical and <br /> alphabetical (per grantors' last name) order should be <br /> maintained in the Public Works Department. <br />
