<br />from the Project Site and for the removal and disposal of <br />surface and subsurface contaminants from the Project Site and <br />affected adjacent property (the "Plan") and implementation of <br />the Plan in accordance with this Agreement (together referred <br />to as the "Work"), as described in that certain report <br />submitted to the Owner entitled "Preliminary Site <br />Investigations - 630 East Hopkins Street" dated April 10, 1989 <br />(the "Report") the terms and conditions of which are fully <br />incorporated into this Agreement, as presented to the Owner by <br />the Contractor and the Primary Subcontractor. <br /> 2. Schedule of Work. The Contractor shall perform the <br />Work in accordance with the Schedule attached to the Report as <br />Table 6. It is understood and agreed that the Table 6 schedule <br />of Work is preliminary as of the date hereof, and as Contractor <br />completes investigation, testing and site evaluation, <br />Contractor will, from time to time, provide Owner with more <br />definitive scheduling for the Work to be performed pursuant to <br />this Agreement, which schedules may be adjusted from time to <br />time as determined necessary and reasonable by mutual agreement <br />of the parties hereto. <br /> 3. Material and Workmanship. All Work pursuant to this <br />Agreement shall be performed in a good and workmanlike manner. <br />All equipment and material incorporated in the Work covered by <br />this Agreement shall be as from time to time specified in <br />writing by the Owner, and if not so specified by the Owner, <br />shall be new and of the most suitable grade for the purposes <br />intended in the judgment of the Contractor. <br /> 4. Compensation. As compensation for the Work to be <br />performed pursuant to this Agreement, including the preliminary <br />inspection, testing and evaluation provided in the Report, <br />Owner agrees to pay Contractor on a time and materials basis in <br />accordance with the Schedule of Costs attached to this <br />Agreement as Exhibit A. Contractor's minimum, median and <br />maximum estimates of the aggregate cost to Owner of performing <br />the Work is set forth on Table 7 to the Report. Contractor <br />shall, from time to time, provide Owner with more definitive <br />projections of aggregate costs as portions of the Work are <br />completed. Upon execution of this Agreement, Owner is <br />approving the sum of $100,000 for Work completed by Contractor <br />as of the date hereof as described in Contractor's invoice <br />submitted herewith and for initial phases of the Work to be <br />performed by Contractor in accordance with the supplement to <br />Exhibit A. Upon approval by Owner's City Council of itemized <br />cost projections submitted by Contractor from time to time for <br />subsequent phases of the Work, Contractor will be authorized <br />and directed to proceed to perform all phases of Work described <br /> - 2 - <br />
