Day, President <br />Either party to this Agreement may change its address for which <br />notices shall be given hereunder, upon written notice to the <br />other party in accordance herewith. <br /> 17. Designation of Owner Representative. The Owner's <br />representative for this project is hereby designated as George <br />Boeke r, Director of Public Works. <br /> 18. General. <br /> (a) Waiver. Waiver by either party of any breach of <br /> the terms and conditions of this Agreement shall not be <br /> construed as a waiver of any succeeding breach of the same <br /> or any other term or condition hereof. <br /> (b) Assianment. No assignment of this Agreement or <br /> any interest herein by either party hereto shall be valid <br /> without the prior written consent of the other party, which <br /> consent shall not be unreasonably withheld. <br /> (c) Entire Aareement. This Agreement constitutes and <br /> expresses the complete understanding of the parties hereto <br /> with reference to the matters herein set forth and there <br /> are no understandings or commitments not expressly stated <br /> herein. No revision, modification or amendment of this <br /> Agreement shall be valid unless in writing and executed by <br /> the parties hereto. <br /> - 6 - <br />
