<br />H. Civil Rights Act of 1964. Under Title IV of 1964, no person <br />shall; on the grounds of race, color, or national origin, be <br />excluded from participation in, be denied the benefits of, or be <br />subjected to discrimination under any program or activity <br />receiving federal financial assistance. EPS agrees to comply with <br />the forgoing conditions and requirements. <br />1. The Housing and Community Development Act of 1974. "No person <br />in the United States shall on the ground of race, color, national <br />origin or sex be excluded from participation in, be denied the <br />benefits of or be subjected to discrimination under any program or <br />activity funded in whole or in part with funds made available <br />under this title. Any prohibition against discrimination on the <br />basis of age under the Age Discrimination Act of 1975 [42 USCS <br />16Øl et seg.] or with respect to an otherwise qualified <br />handicapped individual as provided in Section 5Ø4 of the <br />Rehabilitaiton Act of 1973 [29 USCS 794] shall also apply to such <br />program or activity." EPS agrees to comply with the foregoing <br />conditions and requirements. <br />J. Interest of Members of City. No member of the governing body <br />of City and no other officer, employee, or agent of City who <br />exercises any functions or responsibilities in connection with the <br />carrying out of this economic development program, shall have any <br />personal financial interest, direct or indirect, in this <br />AGREEMENT; and EPS shall take appropriate steps to assure <br />compliance. <br />K. Amendments. This AGREEMENT shall be amended only upon mutual <br />written agreement by both parties. <br />L. Invalidity of Provisions. That should any provision of this <br />AGREEMENT be held invalid, and inoperative, illegal, or <br />unconstitutional by any Court or competent jurisdiction, such <br />provision shall be deemed separate, distinct, and independent from <br />other provisions of this AGRE~MENT and such holding shall not <br />effect the validity of the remaining portions thereof. <br />M. Notice. Any notices, invoices, or reports relating to this <br />agreement shall be sufficient as sent by the parties hereto in the <br />United States Mail, postage paid to the addresses noted below. <br /> Mayor <br /> City of San Marcos <br /> 63Ø E.
