<br /> -2- <br /> WHEREAS, these aforementioned governmental entities desire to join <br />together as participants in the Tri-County Multi-Agency Special Law <br />Enforcement Unit; <br /> NOW, THEREFORE, for and in consideration of the mutual promises <br />hereinafter expressed and other good and valuable consideration, the <br />receipt and sufficiency of which is hereby acknowledged and confessed, <br />the parties do hereby covenant and agree as follows: <br /> ARTICLE 1. GRANT FUNDS. That the Tri-County ~1ul ti -Agency <br />Special Law Enforcement Unit shall be administered by the County of <br />Coma 1 by and through its authorized representative, Fred Clark, <br />County Judge, or his designee. As the administrative agent for the <br />Grantee, the County of Comal shall disburse any grant monies which <br />are awarded and approved for allocation in accordance with the grant <br />application, a copy of which is attached to this agreement <br />as Exhibit A and included herein for all intents and purposes, and in <br />accord with the Statement of Grant Award which is expected to <br />be issued to the Tri-County Multi-Agency Special Law Enforcement <br />Unit. <br /> ARTICLE 2. BUDGET. The parties to this agreement agree that the <br />budget categories and the budget amounts allocated to the Tri-County <br />Multi-Agency Law Enforcement Unit by the terms of the Statement of <br />Grant Award shall control the distribution of funds to carry out the <br />intent and purposes of this Agreement. No other representation <br />pertaining to the distribution of funds and disbursements made to carry <br />out the intent and purposes of this Agreement, whether written or oral, <br />shall be valid unless approved as an amendment to the grant by the <br />Office of the Governor, Criminal Justice Division, in accordance with <br />the rules governing amendments to said grants. <br /> ARTICLE 3. REIMBURSEMENT. In consideration and recognition of <br />the participation of the County of Comal as the administrative <br />representative of the Tri-County Multi-Agency Special Law Enforcement <br />Unit, it is agreed that no county or municipality participating in this <br />Agreement shall request from the County of Carnal reimbursement for any <br />services performed in furtherance of, or pursuant to this Agreement. <br />Likewise, the County of Carnal shall not request reimbursement for any <br />services it performs as the administrative agent and a participant in <br />the Tri-County Multi-Agency Special Law Enforcement Unit from any other <br />party to this Agreement. <br /> ARTICLE 4. BUSINESS RECORDS. It is hereby agreed that during <br />the term of this Agreement and for a three year period thereafter, the <br />County of Comal shall keep and maintain accurate and current records <br />supported by case number, offense and date of incident so that the <br />Tri-County Multi-Agency Special Law Enforceme~t Unit will be able to <br />provide verification of program activities and seized funds. <br /> ARTICLE 5. FORFEITURES. The parties agree that all forfeitures <br />of seized funds shall be received by and inure to the benefit of the <br />jurisdiction in which the case that results in such forfeiture <br />originated. The parties agree further that all expenditures of <br />forfeited property shall comply with the stricter provisions of either <br />Texas law or the federal regulations governing the grant made to the <br />Tri-County Multi-Agency Special Law Enforcement Unit. <br /> ARTICLE 6. SPECIAL CONDITIONS. It is agreed that the <br />Tri-County Multi-Agency Special Law Enforcement Unit shall abide by, be <br />governed by, and adhere to the terms and provisions of the following: <br />
