<br />14 <br /> <br /> <br /> <br /> <br />LEASE AGREEMENT <br /> <br /> <br />THIS AGREEMENT, made and entered into this 1 day of <br />June, 1989, by and between YEUNG H. CHAN and wife, HUI <br />ING CHAN, whose address is 500 W. Court Street, Seguin, Texas, <br />78155, hereinafter called LESSOR, and the City of San Marcos, <br />Texas, a municipal corporation located in Hays County, Texas and <br />existing by and under the laws of the State of Texas whose <br />principal address is at 630 East Hopkins, San Marcos, Texas, <br />78666, acting through authority conferred on its City Manager, <br />Larry D. Gilley, hereinafter called LESSEE; witnesseth that: <br /> <br />NOW THEREFORE, in consideration of the rents to be paid and <br />the mutual covenants to be performed, the parties hereto agree as <br />follows: <br /> <br />1. DESCRIPTION OF LEASED PREMISES <br /> <br />LESSOR hereby leases to LESSEE and LESSEE leases from LESSOR a <br />building located at 510 W. Court Street, Seguin, Texas, <br />(hereinafter called the "Leased Premises") and upon the following <br />described real property, to-wit: <br /> <br />0.42 acres of land situated in NCB Number 1051, Humphries <br />Branch Survey, Abst. 6, Seguin, Guadalupe County, Texas. <br /> <br />BEGINNING at the southwest corner of the tract herein <br />described, said corner being in the north line of West Court <br />Street (U.S. Highway 90-A) and situated E 246.3 feet from the <br />intersection of said line and the east line of Saunders <br />Street. Said place of beginning is further described as <br />being the southeast corner of a tract conveyed by Billy Jones <br />to 100,000 Auto Parts Incorporated by deed dated March 10th, <br />1976 and recorded in Volume 514 at page 408 of the deed <br />records of said county; <br /> <br />THENCE with the east line of said 100,000 Auto Parts <br />° <br />Incorporated Tract, N 0 26' E 165.1 feet to the northwest <br />corner of the tract herein described; <br /> <br />THENCE with fence along a common line of Old City Blocks 52 <br />and 58, S 89° 39' E 73.55 feet to an iron stake set for the <br />northeast corner of the tract herein described; <br /> <br />THENCE with the west line of a tract called 0.275 acre in <br />conveyance from Otto Baenziger to the City of Seguin, as <br />follows: <br /> <br />S 25° 11' E 75.0 feet to an iron stake set at the end of <br />a rock wall; <br />thence with said wall, S 22° 49' E 106.8 feet to a tack <br />set in a lead plug in the top of a COncrete retaining <br />wall; <br /> <br />THENCE with the north line of West Court Street, N 89° 21' W <br />147.95 feet to the place of beginning and containing 0.42 <br />acre of land. <br /> <br />2. OUIET POSSESSION <br /> <br />The LESSOR covenants that it has good title to said real estate, <br />and that LESSEE, upon paying the rentals herein required and <br />observing, performing and keeping all and singular the covenants <br />and agreements herein specified to be kept and performed by LESSEE <br />shall, and may lawfully, peacefully, quietly and exclusively have, <br />hold, use, occupy, possess and enjoy the premises hereby leased <br />for and during the term hereof, without any hindrance, eviction, <br />molestation, or interruption of or by the LESSOR, or other person <br />or persons. <br /> <br /> <br />-1- <br />
