<br />3. TERM AND "AT WILL" TERMINATION <br />The LESSOR agrees, and does hereby, lease the premises to the <br />LESSEE for an original term of six (6) months, commencing on the <br />first day of June, 1989 and continuing through November 30, 1989 <br />unless sooner terminated as provided hereinafter. This agreement <br />may be terminated by LESSEE, at will, upon 10 days' prior written <br />notice to LESSOR. This agreement may be terminated by LESSOR, at <br />will, upon 30 days' prior written notice to LESSEE. <br />4. RENEWAL <br />It is further agreed that, at the expiration of the original term, <br />the IÆSSEE shall have the right, exercisable at its sole option, <br />to extend this lease for one additional term of six ( 6) months <br />upon the giving by LESSEE of ten (10) days' prior written notice <br />to LESSOR. <br />5. RENT <br /> As rent for the premises, the LESSEE agrees to pay to the <br />LESSOR at 500 W. Court Street, Seguin, Texas, or at such other <br />places as are mutually agreed, the amount of four hundred fifty <br />dollars ($450.00) per month, payable in advance prior to the first <br />day of each month of the lease term. <br /> If the commencement date of the term of this lease shall be <br />other than the first day of the calendar month, the rent for such <br />partial month shall be calculated and prorated on the basis of a <br />30-day calendar month. <br />6. USE OF LEASED PREMISES <br /> LESSEE may use the leased premises for the following <br />purposes: <br /> Performance of professional, administrative and clerical <br />services by San Marcos, Texas Women's, Infants' and Children's <br />(WIC) Project No. 36. <br />7. HOLD HARMLESS AND INDEMNIFICATION <br /> LESSEE agrees to protect and save the LESSOR harmless from <br />any and all claims of others for injuries to persons or property <br />arising out of LESSEE'S negligent conduct of its business <br />operations on the leased premises. <br /> LESSOR agrees to hold harmless and indemnify LESSEE from any <br />and all claims of others for injuries to persons or property <br />arising out of defects in or dangerous conditions of the leased <br />premises; provided, however, that if LESSEE has knowledge of a <br />dangerous condition or a defect which LESSOR could not otherwise <br />have knowledge, LESSEE shall notify LESSOR of such dangerous <br />condition or defect as soon as possible after learning of such <br />condition or defect. <br />8. REMOVAL OF FURNITURE. FIXTURES. AND EOUIPMENT <br /> <br /> The LESSEE shall have the right to remove any and all <br />furniture, fixtures, and equipment it may have installed on or in <br />the leased premises, provided that LESSEE shall restore any <br />structural damage to the building as the result of such removal, <br />usual wear and tear excepted. <br />9. ENTRY BY LESSOR <br /> The LESSOR shall have the right to enter the leased premises <br />at any reasonable time for the purpose of performing any duties <br />required of him/her under this lease. "Reasonable Time" shall be <br />construed to mean during normal business hours, except in <br />emergencies. <br /> -2- <br />
