AMENDMENT NO. I 90 to the CONTRACT FOR SAN MARCOS TRANSPORTATION AND DEVELOPMENT PROGRAM between the CITY OF SAN MARCOS & THE GOODMAN CORPORATION WHEREAS, on the 22nd day of May, 1989, the City of San Marcos, Texas and The Goodman Corporation did enter into a contract relating to consulting services in connection with the San Marcos Transportation and Development Program; and, WHEREAS, the parties to said contract desire to amend same; now, therefore, It is understood and agreed by the parties hereto that the following amendment is incorporated into the Contract for San Marcos Transportation and Development Program dated May 22, 1989 between the City of San Marcos and The Goodman Corporation and is subject to the terms and provisions of the contract, except as stated below: ARTICLE V - Compensation of said contract is deleted in its entirety and the following language substituted in its place: ARTICLE V - Compensation CONSULTANT shall be compensated, on a lump sum percent of completion basis, a total amount not to exceed Fifty Thousand Dollars ($5Ø,ØØØ.øØ) for performance of the Scope of Services defined in Exhibit A. CONSULTANT acknowledges that CITY has entered into a contract, a copy of same being attached hereto as Exhibit B and incorporated herein for all purposes, with Hays County and Southwest Texas State University to secure joint local support for the successful completion of the services described in Exhibit A. CONSULTANT and CITY agree that Exhibit B, which is attached hereto and incorporated herein for all purposes, accurately reflects the total funding resources which will be used to support the scope of services as defined in Exhibit A.
