115 INTERLOCAL AGREEMENT This Agreement is made this ~ day of August, 1989 by and between the city of San Marcos (City) and the San Marcos Independent School District (District). This Agreement concerns the paving by the City of a parking lot owned by the District adjacent to San Marcos High School. 1. The District agrees to pay the sum of seven thousand eight hundred and forty-four dollars and thirty cents ($7,844.30) to the City for the paving of the unpaved parking lot adjacent to San Marcos High School identified by the District to the City. 2. The City agrees to furnish all materials and equipment necessary, and to perform all work necessary to pave the parking lot identified to it by the District for the sum of seven thousand eight hundred and forty-four dollars and thirty cents ($7,844.30). 3. Construction by the City shall begin upon execution of this Agreement by the undersigned officials. 4. Construction by the City shall be completed before August 28, 1989. 5. The District shall be responsible for painting all lines on the parking lot. 6. This Agreement is entered into pursuant to the Interlocal Cooperation Act, Vernon's Annotated civil Statutes article 4413(32c); therefore, neither the City nor the District has in any way modified, altered, abrogated or waived any immunity or immunities available to it as a governmental entity under the laws of the State of Texas or the United States of America. 7. This document is the Final Agreement of the Parties. There are no representations or promises other than those set out herein. This Agreement may be modified only with the written approval of the City and the District. 8. This Agreement has been approved by the San Marcos Independent School District and by the City of San Marcos, and is executed by officials duly authorized to take such action.
