<br /> -3- <br /> A. Flight instruction and ground school, rental of aircraft, and <br /> retail sales of fl igh t instruction materials and supplies. <br /> B. It is agreed that the conduct of additional reasonable <br /> aviation-related activities may be allowed subject to LESSOR's <br /> prior approval and re-negotiation of consideration. <br /> LESSEE agrees that in its conduct of operations set forth in <br /> (A.) and/or (B.) above: <br /> (1) to furnish such services on a fair, equal and non- <br /> discriminatory basis to all users thereof; and <br /> ( 2) to charge fair, reasonable and non-discriminatory prices <br /> for each unit of sale or service, provided that LESSEE may <br /> be allowed to make reasonable and non-discriminatory <br /> discounts, reba tes or other similar types of price <br /> reductions to volume purchasers. <br /> IV. <br /> Other Use by LESSEE of Leased Premises. <br /> <br /> LESSOR hereby grants permission to LESSEE to contruct, and LESSEE <br /> shall construct at its expense, a metal hangar building upon the leased <br /> premises for the storage of LESSEE's aircraft and the conduct of <br /> commercial activities provided for in Paragraph III hereof, and said <br /> hangar shall contain, at a minimum, an office area and at least one (1) <br /> classroom. All improvements and alterations made by LESSEE on the <br /> leased premises are subject to approval by LESSOR in writing prior to <br /> construction to determine that such proposed construction is in <br /> accordance with the uses and purposes contemplated by this <br /> Agreement. Construction by the LESSEE of the hangar building shall be <br /> conducted so as not to interfere with the use of the remainder of the <br /> Airport by the general public. No mechanic's or materialman's liens <br /> shall be fixed against the leased premises. Construction of the <br /> hangar building contemplated by this Agreement shall be completed <br /> within one (1) year of the execution of this l\greement. <br /> LESSOR shall have the right to enter the leased premises at all <br /> times during construction and to inspect all phases of construction of <br /> said metal hangar building, and LESSEE covenants and agrees that <br /> it will permit such entrance by LESSOR at all times.
