DESCRIP~10N OF 0.23 ACRBS, MORE on LESS, OF LAND AREA IN THE JOEL MINER SURVEY, H~YS COUNTY, TEXAS, BEING A POR~ION OF THAT 10.67 ACRE TRACT DESCRIBED IN A DEED FROM KITTY PAGB YARRINGTON TO TIlE STATE OF TEXAS, DATED FEBRUARY 7, 1935, AND RECORDED IN VOLUME 110, PAGE 219 OF THB HAYS COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at an 1/211 1ron rod set 1n a northeast line of the 10.67 acre tract from which an east corner of the 10.67 acre tract bears S 47° 33- 27" E 229.79 feet, being in the east line of the present Interstate Highway No. 35 right-of-way, ~nd being in the west line o£ that 97.B4 acre tract described in a deed rrom Albert M. Walker, Tru8tee, to Larry Wehrman et al dated January 13, 1966, and recorded in Volume 714, Page 603 of the Hays County Deed Records (which 1s 1n contlict with the 10.~7 ~cte tract) from which a 3/4" iron pipe founð fOt the northwest corner of the Wehrman tract b&arl N 24° 30' 33" E 951.50 feet, and from which a COncrete highway monument in the east line of Xnterstate Highway No. 35 bears N 24~ 30' 33" E 4326.34 feet and f~om which a concrete hi9hwðy monument found for reference bears S 37° 12' 5111 W 5.27 feet; THaNCE entering the Wehrman tract w!th the northeast line of the 10.67 acre tract S 47° 33' 27" E 26.28 feet to an 1/2" iron roã set for the aast corner of this ttac~r THBNCB crossing the 10.67 ~cre tract with a line 25 feet from and parallel to the extension of the east line of the highway S 24° 30' 33ft W 368.83 feet to an 1/2" iron rod .at 1n the curving southeast line of the 10.67 acre tract; THßNCE with the Southeast 11ne of the 10.67 acte tract bein9 a left breaking curve having the following characteristics: central angle ~ loO2'O6t1r radius. 2925.00 feet, arc length = 52.83 feet and a chord which bears s 52~ 45' 07" W 52.83 feet to an 1/2~ iron rod set for the ~outh corner of this tract in the east line of Interstate Highway No. 35 ana west line of the Wehrman tract from which a concrete highwar monumen~ found in the east line of the highway bears S 24g 30' 33" W 3351.62 feet, and from which a concrete highway monUment found for reforence bears N 65° 46' 10" W 0.72 feet, THENCE recrossing t11e 10.61 acre tract with an extension of the east line of th@ highway ~eing the west line of th~ Wehrman tract N 24030' 33" E 423.46 feet to the PLACE OF BEGINNING. Thete are contained within these metes and bounds 0.23 acres, more or less, of land-area as prepared from public records and surveys made on the ground during May, 1999, by Byrn & ASsociates, Inc. of San Marcos, Texas.
