<br /> 119 <br /> THE STATE OF TEXAS X <br /> X CONTRACT FOR APPRAISAL SERVICES <br /> COUNTY OF TRAVIS X <br /> THIS AGREEMENT is made between City of San Marcos, ("Client"), having a <br /> place of business at 610 E. Hopkins, San Marcos, Texas 78666, and AUSTIN <br /> VALUATION CONSULTANTS, INC., ("Appraiser"), having a place of business at <br /> 3600 Bee Cave Road, Suite 200, Austin, Texas 78746. <br /> For and in consideration of the mutual covenants and agreements contained <br /> herein, Client and Appraiser hereby agree as follows: <br /> I. <br /> The real estate to be appraised is identified as: See attached <br /> Exhi bit "A". <br /> II. <br /> The interest to be appraised is easement interest; remainder properties <br /> immediately before the taking and immediately after the proposed <br /> acqui sit ions. <br /> III. <br /> The purpose of the appraisal is to estimate market value, as defined by <br /> current professional appraisal standards. This report will be prepared in <br /> conformity with and subject to the requirements of the Code of Professional <br /> Ethics and the Standards of Professional Practice of the American Institute <br /> of Real Estate Appraisers, the Uniform Standards of Professional Practice <br /> and of the Texas Real Estate Commission. It is the understanding of <br /> Appraiser that the appraisal report will be used by Client as follows: <br /> land acquisition negotiations and condemnation proceedings in connection <br /> with Clients Northeast I.H. 35 Waterline Extension (Texas Capital Fund) <br /> Project, ("Project"). Client intends to acquire public utility easements <br /> on, over and across the real estate described in Attachment "A" for the <br /> purpose of placing, constructing, installing, repairing and maintaining <br /> water, wastewater, electric, telephone, telegraph, and any and all other <br /> types of public utility structures, pipes and/or lines along, across, <br /> through, under and over said easement, together with free ingress, egress <br /> and regress thereto and therefrom. <br /> IV. <br /> Special instructions and/or limits of assignment (if any), as to the scope <br /> of the appraisal work to be performed, as to the form of the appraisal <br /> report to be prepared, and reasonable hypothetical conditions or <br /> assumptions to be considered are as follows: <br />
