<br /> OUT OF THE J.M. VERAMENDI SURVEY NO. 2, HAYS COUNTY TE~'S,
<br /> AS RECORDED IN VOLUME 2, PAGE 315 OF THE HAYS COUNTY PLAT
<br /> RECORDS, AND A PARCEL OF LAND CONTAINING 9.0555 ACRES
<br /> OUT OF THE J. M. VERAMENDI LEAGUE NO. 2, HAYS COUNTY,
<br /> TEXAS, AND LYING WHOLLY WITHIN THAT 30.0 ACRE TRACT
<br /> CONVEYED BY E.S. SUTTON AND LILLIAN SUTTON TO THE CITY
<br /> OF SAN MARCOS BY THAT DEED DATED NOVEMBER 3, 1950, FILED
<br /> NOVEMBER 3, 1950, AND RECORDED ON NOVEMBER 13, 1950 IN
<br /> VOLUME 148, PAGES 138-139 OF THE DEED RECORDS OF SAID
<br /> COUNTY, SAID 30.0 ACRE TRACT BEING A PART OF THAT 81.38
<br /> ACRE TRACT CONVEYED BY H. D. JONES AND OLLIE MAE JONES
<br /> TO L.O. LESTER BY THAT DEED DATED MAY 10, 1944, FILED
<br /> MAY 17, 1944, AND RECORDED ON MAY 17, 1944 IN VOLUME 129,
<br /> PAGES 621-624 OF THE SAID DEED RECORDS, TO THE CITY OF
<br /> SAN MARCOS, LOCATED ON THE EAST SIDE OF THE 1400 BLOCK
<br /> OF IH-35 NORTH FROM COMMERCIAL TO PUBLIC AND DECLARING
<br /> AN EFFECTIVE DATE.
<br /> WHEREAS, on April 18, 1989, during the Joint Planning and
<br />Zoning Commission meeting of the City of San Marcos a public hearing
<br />was held regarding a request to amend the Future Land Use Plan
<br />01ap) of the Master Plan from Commercial to Public for Lot
<br />lout of the San Marcos Tract, a subdivision of the J.M. Veramendi
<br />Survey No. 2, Hays County, Texas, as recorded in Volume 2, Page 315
<br />of the Hays County Plat Records, and a parcel of land containing 9.0555
<br />acres out of the J.M. Veramendi League No. 2, located on the east
<br />side of the 1400 Block of IH-35 North, Hays County, Texas; and,
<br /> ~'JHE REAS, subsequent to said public hearing on said date, said
<br />Commissions did, on April 18, 1989, consider said request and voted
<br />to approve the same and have recommended that such request be approved
<br />by the City Council of said City; and,
<br /> WHEREAS, said City Council held a public hearing on the 28 day
<br />of August , 1989, regarding such request; and,
<br /> WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br /> WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> PART 1. That the following described tract of real property
<br />10cated at the 1400 Block of IH-35 North, Sãn Marcos, Hays County,
<br />Texas, which is in an area shown on the Future Land Use Plan (Map) of
<br />the Master PIan of the City of San Marcos as Commercial shall be shown
<br />on said map as Public:
<br /> LOT lOUT OF THE SAN MARCOS TRACT, A SUBDIVISION OF THE J. M.
<br /> VERAMENDI SURVEY NO. 2, HAYS COUNTY, TEXAS, AS RECORDED IN
<br /> VOLUME 2, PAGE 315 OF THE HAYS COUNTY PLAT RECORDS, and
<br /> A parcel of land containing 9.0555 acres out of the J.M.
<br /> Veramendi League No. 2, Hays County, Texas, and lying wholly
<br /> within that 30.0 acre tract conveyed by E.S. Sutton and Lillian
<br /> Sutton to the City of San Marcos by that deed dated 3
<br /> November 1950, filed 3 November 1950, and recorded on 13
<br /> November 1950 in Volume 148, Pages 138-139 of the deed records
<br /> of said county, said 30.0 acre tract being a part of that
<br /> 81.38 acre tract coDveyed by H. D. Jones and Ollie Mae Jones
<br /> to L.O. Lester by that deed dated 10 May 1944, filed 17 May
<br /> 1944, and recorded on 17 May 1944 in Volume 129, Pages 621-624
<br /> of the said deed records.
