<br />This 9.0555 acre parcel is shown on a plat of a survey dated 14 <br />April 1989 by Charles R. Swart, Surveyor, and is more <br />particularly described by metes and bounds in the following <br />paragraphs. The brass capped iron monument cited at points 73, <br />75, and 76 is a 5/8 inch diameter iron bar, 36 inches long, \,¡i th <br />a two inch diameter brass cap marked <br /> CITY OF SAN MARCOS <br /> 1989 <br /> CHARLES R. SWART <br /> SURVEYOR <br />and with the point number shown on the plat and cited herein. <br />Those monuments cited as witness monuments are also marked "w. <br />C. II and with the offset distance to the point witnessed. The <br />brass capped iron monument cited at point 29 is a 5/8 inch <br />diameter iron bar, 36 inches long, with a 2 inch diameter brass <br />cap marked <br /> TEXAS DEPART. OF PUBLIC SAFETY <br /> 1989 <br /> 29 <br /> CHARLES R. S~¡¡ART <br /> SURVEYOR <br />the monuments cited as found at points 30, 31 and 32 are hexagon <br />shaped aluminum caps, 2 inches across flats, marked <br /> TEXAS DEPARTMENT OF PUBLIC SAFETY <br /> 1982 <br /> CHARLES R. SWART, SURVEYOR <br />and with the point number. <br />Bearings are based on the record bearing of South 37 degrees 02 <br />minutes 29 seconds West for the southeast right of way line of <br />IH-35, as this line was found marked on the ground by Texas <br />Highway Department concrete piers with brass tablets at stations <br />818 + 31. 39 and 843 +00. <br />Beginning at the point of intersection of the southeast right of <br />way line of IH-35 and the northeast line of the said 30.0 acre <br />tract, from which the Texas Highway Department concrete pier <br />with brass tablet which is 200 feet left of the center line at <br />Station 818 + 31.39 bears North 37 degrees 02 minutes 29 seconds <br />East a distance of 54.35 feet, and a 3/4 inch I.D. iron plpe <br />found in place bears South 48 degrees 12 minutes 29 seconds East <br />a distance of 0.26 feet; <br />thence, from the point of beginning, South 48 degrees 12 minutes <br />29 seconds East along the northeast line of this 9.0555 acre <br />parcel and the northeast line of the 30.0 acre tract a distance <br />of 961.94 feet to the east corner of this 9.0555 acre parcel <br />which is identical with the east corner of the 30.0 acre tract, <br />and is marked with a 1/2 inch diameter iron bar found in place; <br />thence South 42 degrees 28 minutes 35 seconds West along the <br />southeast line of this 9.0555 acre parcel and the southeast line <br />of the 30.0 acre tract a distance of 469.62 feet to a 3/4 inch <br />I. D. iron pipe set at the south corner of the 9.0555 acre <br />parcel, from which a brass capped iron witness monument (point <br />75) bears North 49 degrees 16 minutes 30 seconds West a <br />distance of 8.00 feet; <br />thence, from the south corner of the 9.0555 acre parcel, North <br />49 degrees 16 minutes 30 seconds West along the southwest line <br />of the 9.0555 acre parcel a distance of 547.18 feet to a brass <br />capped iron monument (point 73) at the east corner of the <br />intersection of the 15 foot and 20 foot wide lanes subject to <br />that easement granted by Lon O. Lester and Wilkie Lester to Luis <br />Gil and Petra Gil by that deed dated 9 March 1950, filed 9 March <br />1950, and recorded on 13 March 1950 in Volume 145, pages 6l8-621 <br />of the said deed records; <br />
