<br />LEASE AGREEMENT
<br />
<br />
<br />THIS AGREEMENT, made and entered into this 30th day of
<br />August, 1989, by and between L. Ray Goff, whose address is P.O.
<br />Box 494, Kerrville, Texas, 78029, hereinafter called LESSOR, and
<br />the City of San Marcos, Texas, a municipal corporation located in
<br />Hays County, Texas and existing by and under the laws of the State
<br />of Texas whose principal address is at 630 East Hopkins, San
<br />Marcos, Texas, 78666, acting through authority conferred on its
<br />City Manager, Larry D. Gilley, hereinafter called LESSEE;
<br />witnesseth that:

<br />NOW THEREFORE, in consideration of the rents to be paid and
<br />the mutual covenants to be performed, the parties hereto agree as
<br />follows:
<br />
<br />1. DESCRIPTION OF LEASED PREMISES
<br />
<br />LESSOR hereby leases to LESSEE and LESSEE leases from LESSOR a
<br />building located at 1300 E. Main Street, Kerrville, Texas,
<br />(hereinafter called the "Leased Premises") and upon the following
<br />described real property, to-wit:

<br />Block BO, Lots 14 and 15 of the Tivy Addition, Kerrville,
<br />Texas.
<br />
<br />2. QUIET POSSESSION
<br />
<br />The LESSOR covenants that it has good title to said real estate,
<br />and that LESSEE, upon paying the rentals herein required and
<br />observing, performing and keeping all and singular the covenants
<br />and agreements herein specified to be kept and performed by LESSEE
<br />shall, and may lawfully, peacefully, quietly and exclusively have,
<br />hold, use, occupy, possess and enjoy the premises hereby leased
<br />for and during the term hereof, without any hindrance, eviction,
<br />molestation, or interruption of or by the LESSOR, or other person
<br />or persons.

<br />3. TERM AND "AT WILL" TERMINATION
<br />
<br />The LESSOR agrees, and does hereby, lease the premises to the
<br />LESSEE for an original term of thirteen (13) months, commencing on
<br />the 30th day of August 1989 and continuing through September
<br />30, 1990 unless sooner terminated as provided hereinafter. This
<br />agreement may be terminated by LESSEE, at will, upon 10 days'
<br />prior written notice to LESSOR. This agreement may be terminated
<br />by LESSOR, at will, upon 30 days' prior written notice to LESSEE.

<br />4. RENEWAL
<br />
<br />It is further agreed that, at the expiration of the original t~rm,
<br />the LESSEE shall have the right, exercisable at its sole option,
<br />to extend this lease for one additional term of one (I) year upon
<br />the giving by LESSEE of ten (10) days' prior written notice to
<br />LESSOR.
<br />
<br />5. RENT
<br />
<br />As r.:::nt for the premises, the LESSEE agrees to pay to thn
<br />LESSOR at P.O. Box 494, Kerrville, Texas, or at such other places
<br />as are mutually agreed, the amount of Five Hundred Dollars
<br />($500.00) per month, payable in advance prior to the first day of
<br />each month of the lease term.

<br />If the commencement date of the term of this lease shall be
<br />other than the first day of the calendar month, the rent for such
<br />partial month shall be calculated and prorated on the basis of a
<br />3D-day calendar month.
<br />
<br />6. USE OF LEASED PREMISES
<br />
<br />LESSEE may use the leased premises for the following
<br />purposes:
