Hopkins <br /> San Marcos, Texas 78666 <br /> RE: Lease between Greater San Marcos Youth <br /> Council and the City of San Marcos <br /> Dear Mr. Taylor: <br /> This letter is to follow up on our meeting of October 18 in regard to proposed <br /> changes/corrections in the lease approved by the city council on August 28, 1989. <br /> 1. Paragraph 18 - Professional liability insurance. The last sentence in the paragraph <br /> needs to be rewritten to be grammatically correct. I assume that the word "insuring" should <br /> ~ be inserted for" and" after "liabili ty insurance.1T Also, we would like to have the required <br /> limits of insurance specified as they are for all the other coverages in the lease. The <br /> current policy has limits of $500,000.00 per occurrence, $500,000.00 aggregate and I would <br /> propose these limits as being sufficient. A copy of the current policy cover sheet is enclosed. <br /> 2. Paragraph 22 - Default. We propose to change the time period for correction of <br /> ~ structural unsoundness to 90 days rather than 30 as currently stated. As we discussed, 30 <br /> days is a very short period in which to identify such a problem, determine appropriate <br /> corrective action, get bids and complete the work. Of course in the event a defect should <br /> be so serious as to constitute a health hazard, the city could take appropriate action under <br /> its building safety and health ordinance authority. We are only asking for an extension of <br /> time in which to cure a default under the lease provisions. <br /> ~ 3. Paragraph 21 - Termination. The designation of IIparagraph 1011 in the last sentence <br /> should be changed to IT paragraph lIlT to refer back to the proper paragraph. <br /> o'îZ- 4. Paragraph 29 - Lessor may enter. The word ITby" in the next-to-last sentence <br /> should be chan~~t word ITbe.1T <br /> ~\(. ,;1 5. Þ;l~raph 7 - lectricity. We would ask the city to consider paying for the <br /> v exte!1sio~ct.rical ervic,e to the p,remises as it has agreed to do for water and sew~r <br /> ~ serVIce. A - ussed, thIS request IS made only to help save money for the non-proflt <br /> organization and we understand this may not be possible due to city policy and/or the <br /> structure and operation of the electric utili ty. <br />
