<br /> garbage and refuse of any kind from the premises during said <br /> term. <br /> 10. Fees. Lessor waives all building, capital recovery and <br /> other fees it may lawfully collect. <br /> 11. Insurance. Rebuilding and Reoair of Damaqe to <br /> structures. Lessee agrees to keep and maintain in effect, fire <br /> insurance with extended coverage, in a sum not less than <br /> Seventy-Five Thousand Dollars ($75,000.00) with a company or <br /> companies licensed to do insurance business in Texas and Lessor <br /> shall be named as an additional insured on said policy or <br /> policies. Copies of said policy or policies shall be provided to <br /> Lessor within thirty (30) days from the date Lessee takes <br /> possession of ~aid premises. In the event the demised premises, <br /> a major portion thereof or any structures or improvements located <br /> on said demised premises shall be damaged or destroyed by <br /> casualty, fire or otherwise, to an extent which renders said <br /> premises unfit for Lessee's purposes, as Lessee may determine, <br /> Lessee may rebuild or repair such damaged or destroyed portions. <br /> In the event Lessee elects not to proceed with the rebuilding or <br /> repair of any structures or other improvements on the demised <br /> premises (if so damaged or destroyed), all insurance proceeds <br /> shall redound to Lessor. If Lessee shall fail to proceed with <br /> such repair or rebuilding for a period of ninety (90) days after <br /> the receipt of insurance proceeds then either party may cancel <br /> and terminate this lease and all insurance proceeds so received <br /> shall be turned over to Lessor.
